1. PROPOSAL
The application seeks approval for a Reconfiguring a Lot - Rural Residential (1 into 2 lots). The
proposed subdivision is for the purpose of two residential lots, Proposed Lot 1 will occupy an area
of 1.8 hectares, and proposed Lot 2 occupying an area of 4.7 hectares
The most southern lot (proposed Lot 2) is subject to topographical constraints and includes a
building envelope of 831m2 and a covenant area of 4.5 hectares. Both lots will access the site via
respective vehicle crossovers.
The applicant has provided a slope stability assessment, bushfire hazard assessment and
management plan, ecological assessment in support of the site characteristics and overlays.
The locality and proposal plan are included below.

2. SITE DETAILS
2.1. Background
There was a pre-lodgement meeting held on 24 March 2022, PLM22/0013.
Correctional mapping has been undertaken by State Government and the site is no longer mapped
as containing Core Koala Habitat. A copy of the koala habitat area determination map issued by
State Government dated 10 January 2022.
2.2. Site Description
There is an existing dwelling and associated outbuildings (Class 10 buildings) on the northern
portion of the premises. The site is subject to dense vegetation, predominantly regrowth rainforest,
with the remaining land managed grassland with low density semi-mature trees. Consequence of
the vegetation there is a potential to medium bushfire risk on the premises.
The highest elevation on the property is towards the front of the lot, where the existing dwelling
and shed are with the lowest point sloping to the rear of the site, an approximate fall of 54 metres
from the highest to lowest contour. The land plateaus along the northern portion of the lot. The
landslide hazard varies from unconstrainted to high hazard area.
2.3. Surrounding Land Uses
The adjoining to the north of the site is of a similar nature to the proposed development, Rural
residential subdivision (1 into 2 lots) with similar site constraints (Council ref. RAL21/0003).
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
Page 5 of 14
Document Set ID: 22158749
Version: 8, Version Date: 12/01/2023
Page 6
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020.
3.2. Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
• Rural Residential Zone Code;
• Hinterland Communities Local Plan Code;
• Reconfiguring a Lot Code;
• Works Codes;
• Biodiversity, Waterways and Wetlands Overlay Code;
• Bushfire Hazard Overlay Code;
• Landslide Hazard Overlay Code.
The subject site is located in Black Mountain and is zoned Rural Residential. The proposed use is
identified as a consistent use within the zone and is required to follow a code assessable
application process.
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below:
Criteria Planning Scheme Proposal Complies
Lot size 1.5 ha / lot 1.8 ha & 4.7 ha
30m min. width 30 metres min.
Lot areas and dimensions
PO6 Development provides for irregular shaped lots to be created only where:
a) the creation of regular lots is impractical such as at a curve in the road or because of
topographical constraints;
b) safe access and visual exposure to and from the site can be provided, while not adversely
impacting on the functionality of the surrounding road network;
c) it is desirable to avoid clearing of vegetation and the fragmentation of habitat
in ecologically important areas; and
d) the irregular lot is demonstrably suitable for its intended purpose.
AO7.3 All reconfigured lots on land subject to a constraint or valuable feature identified on an
overlay map contains a building envelope marked on a plan of development that demonstrates that
there is an area sufficient to accommodate the intended purpose of the lot, that is not subject to
the constraint or valuable feature or that appropriately responds to the constraint or valuable
feature.
The proposed subdivision of land will result in a general east-west lot orientation, with an irregular
shape. The common boundary of the two lots is informed by the existing ecological corridors, and
landslide risk.
The proposed northern lot, proposed Lot 1, has an existing dwelling and associated outbuildings
on the premises. Whereas, the proposed southern lot, proposed Lot 2, is free of structures.
Proposed Lot 2 is subject to greater site constraints and therefore has nominated a building
envelope for any future development of the site, with the majority of the remaining area proposed
to be held in environmental covenant.
The nominated building envelope is 834m2 in size, including area available for onsite effluent.
Page 6 of 14
Document Set ID: 22158749
Version: 8, Version Date: 12/01/2023
Page 7
The applicant has suitably demonstrated that both lots are able to accommodate the intended uses
on the lot without impacting on the ecological values of or the site or creating undue risk to future
landholders.
The development complies with both Acceptable outcomes of the Noosa Plan 2020.
Biodiversity, Waterways and Wetlands
AO1.2 Buildings, structures and associated works are located within existing cleared areas or
areas of lowest ecological value.
AO2 Where clearing vegetation for the purpose of Reconfiguring a Lot:
a) new boundaries to lots do not transect and fragment existing native vegetation;
b) new lots are created to allow for suitable building envelopes for future buildings and works
to be located within existing cleared areas or areas of low ecological value;
c) building envelopes are designated for each lot; and
d) ecological linkages and ecologically important areas are secured by environmental
covenant or transferred to public ownership or through gazettal of a nature reserve.
PO2 New lots are only created if they maintain ecological linkages and minimise
the clearing of vegetation.
Following completion of the subdivision there will be a portion of vegetation contained within an
area of biodiversity significance which will be exposed to exempt clearing, an approximate area of
135m2. The area of potential clearing is considered reasonable due to the extent of rehabilitation
to be undertaken on site and that the environmental covenant will secure the protection of the
ecological linkages across the site.
Landslide Hazard
A site-specific geotechnical report has been provided and found that the site has a low risk of slope
instability and is appropriate for further development subject to the recommendations within the
report (refer to Appendix H – Geotechnical Report). It is requested that a development approval
be conditioned accordingly to ensure compliance
Bushfire Hazard
AO1.1 Development which will materially increase the number of people living or congregating on
premises, including reconfiguring a lot, is not located within a medium or high bushfire hazard
area.
PO1 Development maintains the safety of people and property from the adverse impacts of
bushfire.
The proposed subdivision of 1 into 2 lots includes a building envelope on proposed Lot 2 which is
identified as both potential and medium bushfire hazard. The building envelope achieves a setback
of 39 metre from the closest hazard vegetation to the southwest, exceeding the minimum setback
of 29.3 metres as per the Flamesol modelling method. The Plan of Development places an
acceptable risk of radiant heat to the building envelope. The development is considered to comply
with the Performance outcome.
4. CONSULTATION
4.1. Referral Agencies
Not Applicable
4.2. Internal Council Referrals
The application was forwarded to the following internal Council officers for review and/or comment:
• Development Engineer
The applicant proposes to subdivide (1 Lot into 2) a property in Black Mountain. Engineering
had concerns that the proposed driveway crossovers would result in the creation of unsafe
traffic conditions due to their proximity and sight distance concerns. The applicant
Page 7 of 14
Document Set ID: 22158749
Version: 8, Version Date: 12/01/2023
Page 8
demonstrated that safe sight distances can be achieved and created separation in the
proposed crossovers to remove ‘driver confusion’. Insufficient information was provided to
demonstrate that either proposed building envelopes for Lot 1 were suitably located and were
removed. A Slope Stability Assessment report was prepared by Tectonic which included
recommendations for the construction of the proposed driveways, crossovers and house
footings. Engineering believe that relevant compliances can be achieved and recommend
the following conditions.
• Senior Environmental Officer – as conditioned.
5. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
