As such, the maximum building height cannot be verified. Information Required Please provide amended plans containing RL levels showing the maximum building height. Provide a copy of the survey plan which was informed the RL levels Issue – Building Height Performance Outcome PO7 of the Low Density Residential Zone code requires that buildings and structures do not exceed 2 storeys. The proposed plans indicate a significant section of the lower level is measured as being 1 metre above the ground level to the floor of the garage. As such, this section is considered to be a storey and not a basement. The proposal is therefore considered to be 3 storeys and is not supported by Council. Information Required Please provide amended plans which show the dwelling to be 2 storeys. Issue – Site Cover Acceptable Outcome AO8 of the Low Density Residential Zone code requires site cover of development does not exceed for a building of 2 storeys – 50% for one of the storeys; and 30% for the other storey; or 40% for both storeys A site cover calculation was not submitted with the proposal and the proposed plans indicate a site cover of 37% for the lower floor, 51% for the ground floor and 21% for the first floor. The proposal therefore does not comply with AO8 and is not supported by Council. Information Required Please provide amended plans which show a site cover which shows 50% for one of the storeys and a maximum of 30% for the others. It is noted that the other storeys must be within the building footprint of the storey which is 50%. Issue – Front Setback Performance Outcome PO9 of the Low Density Residential Zone code seeks buildings and structures are designed and site to be consistent with the predominant character of the streetscape. The proposed plans indicate the eaves are setback between 3.3 and 3.6 metres from the front boundary, whilst the wall is setback between 4.3 and 4.9 metres. It is noted that Council approved a 5.33m setback to eaves and 5.93 setback to the building for the adjoining property to the south. The proposal is therefore not considered be consistent with the predominant character of the streetscape and does not comply with Performance Outcome PO9. The proposed setbacks are not supported by Council. Information Required Please provided amended plans showing a minimum setback of 5.33 metres for the eaves of the dwelling and 5.93 for the building. Issue – Rear Setback Performance Outcome PO4 of the Coastal Protection and Scenic Amenity Overlay requires new buildings and structures are setback no less than 6 metres from the seaward boundary of the site. The proposed cantilevered deck encroaches 3 metres into the rear setback and therefore does not comply with PO4. The purpose of the Coastal Protection and Scenic Amenity Overlay code is achieved through development being designed and sited to protect the visual character and scenic amenity of the Coastal Protection and Scenic Amenity Area and to integrate with the surrounding natural landscape and skyline vegetation. It is noted that the reduced setback increases the opportunity for overlooking into the adjoining properties to the south and north. In addition to adversely affecting the visual character and scenic amenity of the Coastal protection and Scenic Amenity Area. As such, the rear setback encroachment is not supported by Council. Information Required Please provided amended plans showing the eaves of the building setback 6 metres from the rear boundary. due date for response to information request The due date for providing the requested information is 4 February 2022.
