Background
A carport was approved on Lot 11 in 2007, which encroaches onto Lot 5. The carport was approved to be 0.15m from the front boundary and 6 metres from the eastern boundary.

Lot 5 is an irregularly shaped, 6.14 hectare rural lot that is utilised for rural pursuits. The site contains a dwelling house and associated structures. The site slopes steeply from the eastern boundary to the west. A waterway runs through the north-western side of the site. The site is mostly cleared of vegetation with some vegetated areas along the boundary lines.
173 Musa Vale Road –
Lot 11 is a small rural lot and contains a dwelling house, studio and carport. The entirety of the site is covered by a mapped riparian buffer areawhich is located around a small waterway that runs along the eastern boundary. An easement (Easement B) burdens the southern corner of the lot and the south-western boundary.

Site Area	Minimum 100 hectares	Existing 169 Musa Vale Road – 6.14 ha 173 Musa Vale Road – 3,005m2 Proposed 169 Musa Vale Road – 6.14 ha 173 Musa Vale Road – 3,005m2	X X X X
Rearrangement of Lot Boundaries
Acceptable Outcome AO26 of the Reconfiguring a Lot Code requires that the rearrangement of lot boundaries results is an improvement to the existing situation whereby the size and dimensions of proposed lots comply more fully with Table 9.5.1.4 Minimum lot size and dimensions and at least one of the following is achieved:
the rearrangement of lots remedies an existing boundary encroachment by a building or structure;
the rearranged lots will be made more regular in shape;
access is provided to a lot that previously had no access or an unsuitable access;
the rearranged lots better meet the overall outcomes for the zone and the local plan area in which the site is situated;
the rearrangement of lots provides for a significant improvement in rural productivity; or
the rearrangement of lots results in a significant improvement in the protection of environmental values.
The proposal complies with Acceptable Outcome AO26 as it includes rearranging the lot boundaries of the subject sites to eliminate the encroachment of the carport constructed on Lot 11 into the property of Lot 5. The proposed boundary realignment will not change the size of the properties and will not result in any impacts to environmental values on the site. The shared boundaries of the properties are not fenced and the proposed boundary change will not cause any impacts to vegetation in the riparian buffer area. The proposal will also not have any impacts on rural productivity of the subject or surrounding sites and maintains Easement B on Lot 11.
