The proposal includes the addition of louvred screening (aluminium fin screen) on top of the existing rendered block wall, a steel portal framing and new footings with insulated roof panel. As the proposal involves an increase in site cover, changing setbacks and the approved building footprint an application for change is required. The locality and proposal plan are included below. Figure 1 – Locality – subject address highlighted Figure 3 – Floor Plan & Perspective Figure 4 – Elevations background The site forms Precinct E2 of the Noosa Springs residential community. Master planning for the Noosa Springs locality was undertaken in the 1990’s, with the majority of the area now developed for residential and golf course purposes, with associated recreational and community facilities. The subject site and adjoining land to the north (Precinct F) form the eastern extremity of the Noosa Springs locality and were historically used for sand quarrying purposes. Precinct E2 development approval history includes: MCU15/0109 - 16 September 2016 – Decision Notice – 44 units (4 x 1 bedroom, 22 x 2 bedroom and 18 x 3+ bedroom units) subject to amendment to unit density as part of the original condition 4; MCU15/0109 - 20 December 2017 - Negotiated Decision Notice – 37 units (4 x 2 bedrooms and 33 x 3-bedroom units); MCU15/0109.01 - 21 February 2018 – Minor Change Decision Notice – 29 units (1 x 2 bedrooms and 28 x 3-bedroom units), which deleted block 26; MCU15/0109.02 - 16 July 2018 – Minor Change Decision Notice – minor amendments to landscaping and fencing. MCU15/0109.03 – 15 March, 2019 – Minor Change Decision Notice – 39 units (17 x 2 bedrooms and 22 x 3 bedroom units); and MCU15/0109.04 – 22 March, 2022 – Minor Change Decision Notice – 39 Units & 1 Manager’s Unit assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and The Noosa Plan 2020. Statutory Process The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’. The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that: the development would not result in substantially different development as the development remains generally consistent with the original approval; the change does not include prohibited development; the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation; where the original application was code assessable, the change would not cause the application to become impact assessable. Statutory Instruments – Planning Scheme To facilitate the proposed changes the applicant seeks changes to the approved list of plans of development being condition 2 Applicant’s Request Request: It is requested that condition 2 Plans of Approval list is updated to include the latest Architectural Package for Unit 1202 Courtyard area The list of approved drawings to be updated to incorporate the following plans: Plan No. Rev. It is proposed to include a roofed pergola /cabana structure and associated screen to one side of the existing paved courtyard area. The current site cover for the entire development is 29% (rounded) or 3,420.5m². The proposed roof over the existing courtyard area results in 30.69m² of additional roofed area for Unit 1202. Based upon the total site area of 11,799m² the total increase to site cover is 0.24% (less than 1%). Therefore, the total site cover is 29.24% and is significantly less than the allowable 40%. The proposed change to include a pergola / cabana structure over the existing courtyard area of Unit 1202 does not change population density, gross floor area or plot ratio. A condition is recommended to ensure the pergola area remains unenclosed (as per the proposed plans) and therefore does not contribute to GFA. The proposed structure is compliant with side boundary setbacks being greater than 1.5m and exceeds the rear boundary setback of 6m, the height is single storey (3.4m to the outermost projection) and does not exceed the maximum height limit in Noosa Heads of 12 metres under the current planning scheme or 8 metres under the superseded Noosa Plan 2006. The proposed minor change to include a roofed pergola does not raise any significant issues and is compliant with planning scheme requirements and can therefore be supported. cONSULTATION Referral Agencies Not applicable Internal Council Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
