Cover Letter 25.06.2024
25 June 2024 State Assessment and Referral Agency [email protected] RE: Minor Change Application for MCU & OPW To whom it may concern, This letter provides details regarding a Minor Change request for the existing approvals MCU22/0203 and OPW22/0304 for dredging and beach nourishment at Noosa Dog Beach. Noosa Shire Council has a development approval and environmental authority to undertake dredging and nourishment works to mitigate erosion at the Noosa Spit (Dog Beach). This minor change is subsequent to the minor change 19 February 2024, 2401-38634 SPD. This request includes the extension of sand extraction zone by 50m to enable the removal of a sand bank that has migrated since design. The removal of this sand bank will maximise the effectiveness of design in reducing erosion, while enhancing navigation safety. This request is urgent as approved works are currently underway and has been discussed with agencies prior to lodgment. • The works are a continuation of the current approved works and drawings of Environmental Approval (P-EA- 100375359) and development approval (SARA 2401-38634 SPD), where it is only the self-nominated collection footprint being amended. • Works would be completed under the existing conditions of the current Environmental Approval (P-EA- 100375359). • No additional impacts to marine vegetation are expected. • The volume of material (sand) is expected to be as permitted within the current Environmental Approval (P- EA-100375359) and development approval (SARA 2401-38634 SPD). The proposed changes are as follows: 1. It is requested that additional drawing Noosa-DB-01 be included in the approved plans to allow dredging in the 50m extension zone. This drawing is to be added to the following conditions: 3, 8, 12 & 21. Assessment on whether proposed change is a Minor Change: Under the definition from Schedule 2 of the Planning Act 2016, it is considered that the proposed change is a Minor Change. The minor change includes the extension of under 4% of the original self-nominated sand extraction zone (6,309m2 extension, original 169,627m2). The volume of sand to be extracted remains consistent with the design and approvals. It is considered that the change does not result in substantially different development and if the development, including the change, were made now, it would not cause: A) the inclusion of prohibited development in the application; or B) referral to a referral agency, other than to the chief executive, if there were no referral agencies for the development application; or

C) referral to extra referral agencies, other than to the chief executive; or

regard to, a matter, other than a matter the referral agency must have assessed the application against, or had
regard to, when the application was made; or
E) public notification if public notification was not required for the development application.
