20 Peregian Esplanade, Peregian Beach High level of amenity, including privacy The setback encroachments involve only non‑habitable elements that do not create overlooking, noise or privacy impacts. The design maintains a high level of amenity for both the subject site and adjoining premises. No unreasonable obstruction of views or overlooking As the encroachments relate only to non‑habitable components, they do not introduce sightlines into neighbouring private open space or habitable rooms and do not obstruct views. Adequate distance from adjoining land uses The primary building envelope complies with the required setbacks. The minor non‑habitable encroachments do not compromise separation or amenity. Preservation of vegetation that buffers development Existing vegetation that contributes to screening is retained where practicable, with additional planting proposed to strengthen landscape buffering. Space and landscaping between buildings The site layout provides ample ground‑level space for planting, outdoor living and utilities. Landscaping is used to soften the built form and maintain separation. Soft landscaping along boundaries Soft landscaping, including shrubs and small trees is provided along boundaries to enhance privacy and reduce visual bulk. Open streetscape character As the proposed development is to be undertaken on a rear lot, there are no identifiable impacts to the streetscape character. Protection of natural character and ecological values The site is not located near ecologically significant areas such as waterways, wetlands or national parks. The development therefore does not impact natural character or ecological values. In summary, the proposed development achieves the overall intent of PO14. The only components extending into the setback are minor non‑habitable elements which do not create overlooking, noise, view loss or any other unreasonable amenity impacts. The primary building form complies with the required setbacks, and the proposal improves the existing boundary relationship, as the current dwelling encroaches further into the setbacks than what is proposed.
