20 Peregian Esplanade, Peregian Beach (b) does not include a residential use of premises that involves a secondary dwelling. 6.2.2 Level of Assessment Under the Noosa Plan 2020, the site is identified as being contained within the Medium density residential zone and the following overlays: ▪ Bushfire hazard overlay ▪ Land subject to acid sulfate soils overlay ▪ Landslide hazard overlay In accordance with Part 5 of the Noosa Plan 2020, the proposed changes constitute Code Assessment as per the following: LEVEL OF ASSESSMENT ZONE Medium Density Residential Zone In accordance with Table 5.5.2 – Medium Density Residential, a Dual Occupancy is considered code assessable if not located on Lot 1 RP162459, Lot 165 RP94566 or Lot 162 SP307694, being 102-110 Pacific Avenue, Sunshine Beach or located on a Code assessable lot with an area less than 600m2. As the subject site is not identified as the aforementioned properties, the proposal is subject to Code Assessment with the Medium Density Residential Zone code being addressed as part of this application. OVERLAYS Bushfire Hazard Overlay In accordance with Table 5.9.3 Bushfire Hazard Overlay, a Dual Occupancy is not specified as an accepted use. As such, the proposed development is subject to Code Code assessable Assessment with the Bushfire Hazard Overlay code being addressed as part of this application. Land Subject to Acid Sulfate Soils Overlay In accordance with Table 5.9.1 – Acid Sulfate Soils Overlay, if the proposed development involves the following, it is subject to code assessment. (a) within Area 1 as identified on an Acid Sulfate Soils Overlay Map and involving excavation of 100m3 or more of material at or below 5 metres AHD; or (b) within Area 2 as identified on an Acid Sulfate Soils Overlay Map and Not applicable involving: (c) excavation of 100m3 or more of material; or (d) filling of land with 500m3 or more of material As the proposal does not involve the above, the Land Subject to Acid Sulfate Soils Overlay is not applicable and is not required to be assessed. Landslide Hazard Overlay In accordance with Table 5.9.8 – Landslide Hazard Overlay, a Dual Occupancy is not specified as an accepted use. As such, the proposed development is subject to Code Code assessable Assessment with the Landslide Hazard Overlay code being addressed as part of this application. In view of the above, the proposed development is subject to Code Assessment.
