20 Peregian Esplanade, Peregian Beach CONCLUSIONS This report is submitted on behalf of Pepper and Jarvis Top as Trustee for the Iron Man Trust in support of an Other Change in accordance with s78 & 82 of the Planning Act 2016 to the existing Development Permit over the site at 20 Peregian Esplanade, Peregian Beach QLD 4573, more particularly described as Lots 1-2 on SP269260. This report addresses the merits of the proposed Other Change application with respect to the provisions of the Noosa Plan 2020 and the relevant components of the Planning Act 2016. This Change Application relates to an existing development approval which was originally granted by Council on 25 August 2011 for a Material Change of Use (Development Permit) for a Dual Occupancy (Council Ref: MCU10/2113). Following receipt of the above-mentioned approval, the development has ultimately been delivered with minor modifications being undertaken throughout the years. The applicant seeks to redevelop the subject site to better align with their current needs and stage of life. Specifically, the proposal involves removing the existing dwelling over Lot 2 and constructing a new two (2) storey residence featuring a more uniform, orthogonal layout to enhance functionality and efficiency. In accordance with the provisions in s82 of the Planning Act 2016, an Other Change is to be assessed ‘in the context of the development approval’ with the relevant provisions to apply as if the change application were included within the original development application. However, only the matters for assessment that are relevant to assessing the change in the context of the original approval are relevant to the assessment. Under the Noosa Plan 2020, the site is identified within the Medium Density Residential Zone and the Coastal Communities Local Plan. This zone is intended to provide housing for permanent residents while delivering high-quality architectural and landscape design outcomes. The proposal is considered consistent with the Medium Density Residential Zone as the development: ▪ Delivers a high-quality residential built form that reinforces the intended residential character of the area; ▪ Incorporates architectural articulation, landscaping and subtropical design elements consistent with the design outcomes sought for the locality; ▪ Ensures a cohesive relationship with surrounding development and contributes positively to the local skyline and streetscape; and ▪ Does not result in any unacceptable visual, amenity or overshadowing impacts for the Coastal Communities. Overall, the proposal is identified as meeting the relevant requirements of the Noosa Plan 2020.
