1.4. SITE CONTAMINATION
A portion of the site at Lot 4 on SP246584 is identified on Queensland Environment Management Register
(EMR). The EMR register nominates Lot 4 as containing a Notifiable Activity, being operation of a service
station.
This designation is clearly out-dated as it relates to a time when a nearby service station in the Noosa Civic
Shopping Centre was located on the same lot as the current Lot 4. Over time, the lot configuration in the
area has changed which has resulted in the service station no longer being located on Lot 4. It is therefore
considered that the existence of Lot 4 on the EMR is not a relevant constraint for the proposed development.
The location of the site in relation to the service station is shown in Figure 5 below.

Pursuant to Schedule 10, Part 4 Division 1 of the Planning Regulation 2017, the development is not made
assessable development for contaminated land as the proposed development does not involve a sensitive
land use or a commercial use involving an accessible underground facility.
1.5. LAND OWNERSHIP AND ENCUMBRANCES
The site is held under two freehold titles and Noosa Spotlight Property 2 Pty Ltd is the registered owner of
both sites. Please refer to the Certificate of Title in Appendix A for further reference. The site is
encumbered by easements or covenants as listed in the below Table 1:
