    That the meeting be closed to the public pursuant to section 254J(3)(e) of the Local
    Government Regulation 2012 for the purpose of discussing legal advice relating to an appeal
    in the Planning & Environment Court so that Council’s legal position is protected in relation
    to Item 3 – Planning & Environment Court Appeal No. D144 of 2019 – Application for Building
    Works at 54 Seaview Tce, Sunshine Beach.
                                                                        Carried unanimously.

    3    PLANNING & ENVIRONMENT COURT APPEAL NO. D144 OF 2019 -
         APPLICATION FOR BUILDING WORKS AT 54 SEAVIEW TCE, SUNSHINE BEACH
         Committee Recommendation
         Moved:            Cr Finzel
         Seconded:         Cr Wegener
         That Council note the report by the Manager, Development Assessment to the
         Planning & Environment Committee Meeting dated 10 November 2020 regarding
         Planning & Environment Court Appeal No. D144 of 2019 and agree to settle the appeal
         generally in accordance with the following conditions:
         PLANNING
         When Conditions must be Complied With
         1.     The applicant must provide a copy of the development approval to the private
                building certifier who assesses the subsequent development application for a
                development permit for building works for the construction of the Detached
                House and the associated deck area and pool.

         2.     Development must be undertaken strictly under the approved plans listed in the
                following table unless otherwise amended by these conditions.
