On behalf of Murray Richardson, we hereby provide our formal response to the
matters raised within Council’s Information Request received on 9 April 2019.

Response:

In response to Item 1 of Council’s Information Request, the proposed common
boundary between Proposed Lots 1 and 2 has been strategically positioned in
order to achieve environmental and residential amenity outcomes.

It is considered that the proposal is consistent with the approval given to the
subdivision of neighbouring property 226 Black Mountain Road (RAL18/0010), in
that the proposed subdivision has been designed to respond to the site
characteristics of the property including the topography, accessibility and on-site
vegetation to establish two (2) functional Rural Settlement Lots. Importantly, the
proposed allotments have been carefully designed to avoid the dissection of
vegetation identified on Noosa Council’s Biodiversity Overlay (the common
boundary traverses an area contained in the overlay, which in reality is bare of
vegetation as per Site Photos submitted in original Planning Report).

As a result, Proposed Lot 2 comprises 1.234ha, which is less than the specified 2
hectares minimum. In addition, the proposed subdivision layout has been
designed to maintain privacy between the dwelling houses on each of the
proposed allotments by following natural ridgelines, achieving private, semi-rural,
green allotments suitable for spacious rural living as per the intent of the Rural
Settlement Zone.

As such, the issues identified in Council’s Pre-Lodgement Advice PLM18/0012 in
relation to lot size have now been resolved, as the following overall outcomes of
the Reconfiguring a Lot Code are now satisfied:

a) lot sizes and dimensions that are appropriate for their intended use;
c) lots with suitable, safe and appropriate access;
g) lots that avoid significant adverse effects on the natural environment and
landscape and minimise the risk of hazards for people and property;

Item 2

Issue

There is limited detail provided for the house site on proposed Lot 2. Council has
concerns with the size, setbacks and slope of the house site.

Information Required
2. Provide additional detail on the house site on proposed Lot 2. The detail must
include:

2.1. Dimensions, areas and setbacks to the road, access easement and
        common boundaries; and
2.2. Existing levels and slopes sufficient to demonstrate that the house
site area is not located on a “steep slope” as defined by The Noosa Plan

Response:

Page 3

In response to Item 2 of Council’s Information Request, please refer to the
Amended Plan of Development attached at Appendix A of this request. The
dimensions listed by Council are now detailed on the plan. In addition, TOD
Consulting has prepared a Preliminary Earthworks Plan (attached at Appendix B)
which demonstrates that a house pad complying with the steep slope limitations
of the Noosa Plan (i.e. not above 25%) can be achieved with minimal earthworks
required, with the indicative effluent area as per the original Geotechnical Report
to be located adjacent to the pad demonstrated on the PoD and PEP.

Items 3 & 4
Issue

The proposed access easement is not in accordance with The Noosa Plan
(Planning Scheme Policy 5 – Roads Drainage and Earthworks – Section 2.3) for
the relevant zone. No comment has been provided in regard to proposed
improvements to the formation of the access driveway.

Information Required

3. Provide amended plans that indicate the access easement width to comply with
The Noosa Plan (Planning Scheme Policy 5 – Roads Drainage and Earthworks –
Section 2.3) for the relevant zone.

4. Provide comment on the proposed improvements to the formation of the
access driveway. The improvements must be in accordance with The Noosa Plan
(Planning Scheme Policy 5 – Roads Drainage and Earthworks – Section 2.3) for
the relevant zone.

Response:
In response to Items 3 & 4 of Council’s Information Request, the Amended Plan of
Development (Appendix A) now demonstrates a 10m wide access and services
easement to comply with Planning Scheme Policy 5. A compliant driveway can be
established within this handle with details to be given at Operational Works stage.

3.0 Summary

We trust the additional information provided in this response will allow Council to
issue a successful development approval in due course. If you have any questions
or wish to clarify any matter outlined within this response, please don’t hesitate
to contact me on (07) 5441 2188.

Yours faithfully,
