2. APPLICATION BACKGROUND
The subject operational works application has been submitted to address the conditions
of Court Judgement 1998 of 2024, issued on 26 June 2025 (Council reference: MCU22/0094) for
a Material Change of Use– Childcare Centre.
An associated boundary realignment application (RAL25/0019) was approved by Council on 16
January 2026 and Plan Sealing application (PS26/0006) was approved 15 May 2026.
3. SITE DETAILS
3.1. Site History
The site has historically been vacant.
3.2. Site Description
The site is a vacant 2,476 m² Major Centre zoned lot.
3.3. Surrounding Land Uses
Vacant.
4. ASSESSMENT
4.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (26 September 2025).
4.2. Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
• Works Codes;
The subject site is located in Noosaville and is zoned Major Centre. The proposed use is identified
as a consistent use within the zone and is required to follow a code assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The
pertinent issues arising out of the assessment are discussed below:
Stormwater
The proposed stormwater design is consistent with the intent of the preliminary stormwater
treatment plan approved as part of Court Judgement 1998 of 2024. A lawful point of discharge has
been achieved via an existing stormwater connection provided to the lot as part of previous
operational works (OPW20/0145).
Earthworks
The proposed earthworks align with the preliminary bulk earthworks plan approved as part of Court
Judgement 1998 of 2024.
Access
Access is achieved via an existing vehicle crossover provided as part of previous operational works
(OPW20/0145). Sufficient manoeuvring areas including a turnaround bay and loading bay are
provided, allowing ingress and egress of vehicle in a forward gear. A kerb ramp is shown adjacent
to the existing vehicle crossover, the location is not desirable, conflicting with a traffic island, an
existing pedestrian crossing and refuge island is located approximately 20m away. The applicant
agreed for Council to annotate the plans removing kerb ramp.
Waste
Document Set ID: 24726708
Version: 7, Version Date: 21/05/2026
Page 4
An Operational Waste Management Plan (OWMP) has been submitted in with the application.
Council’s waste has team reviewed the proposal and is supportive of the OWMP. Servicing will be
restricted to occur outside of peak child drop-off or pick up times (10:00am to 2:00pm) where the
refuse collection vehicle (RCV) will have a capacity to use carparking spaces for manoeuvring.
The arrangement avoids peak traffic and pedestrian interactions and allows the RCV to ingress
and egress in a forward gear.
Parking
A nominal ‘no-standing’ period from 10:00am to 2:00pm Monday to Sunday has been proposed for
selected parks to align with the OWMP and allow sufficient manoeuvring area for the RCV. These
timeframes may be reviewed and revised in line with centre specific peak drop-off and pick-up
hours that will be determined once the site is operational.
Signs and Linemarkings
Selected parks are to be signed ‘no-standing’ including time restrictions as required to facilitate the
OWMP. A zebra crossing is provided at the entrance to allow safe pedestrian access.

accordance with the supervising engineer instructions and the current best practice
standards * (Refer to Advisory Note).
30. The developer must ensure non-essential exposure of soil is prevented by restricting the
extent of disturbance and minimising the duration of soil exposure to adverse weather
conditions and effectively turf, cover or stabilise any disturbed area without delay and prior
to rainfall occurring.
31. The developer must ensure sediment does not leave the site or enter onto adjoining
properties or Council’s drainage system due to surface runoff or on tyres of vehicles and/or
machinery. It is essential to implement appropriate approved erosion and sediment control
measures throughout the site during all phases of construction including vehicle shakedown
pad/grid (or similar) at the access to the construction site. Where sediments or other
contaminants are deposited on a road, they must be removed so as not to enter Council’s
drainage system or waterways.
32. Prior to the completion of the development and commencement of use, all site surfaces must
be effectively stabilised using methods which have achieved effective short-term stabilisation
and which will continue to achieve effective stabilisation in the medium to long-term. For the
purpose of this condition, an effectively stabilised surface is defined as one that does not, or
is not likely to result in visible evidence of soil loss caused by sheet, rill or gully erosion or
lead to sedimentation, or lead to water contamination.
