                (b)   a provision of this chapter requires the entity, in making
                      the decision, to consider stated criteria or matters.
          (2)   The stated criteria or matters do not limit the criteria or
                matters the entity may consider in making the decision.

Part 1                       Eligibility criteria

317        Notice of proposed eligibility criteria
          (1)   Before the chief executive makes eligibility criteria for an
                environmentally relevant activity under section 318, the chief
                executive must publish the following on the department’s
                website—
                (a)   a copy of the proposed eligibility criteria; and
                (b)   a notice which states—
                      (i)   that any person may make a submission to the
                            chief executive about the proposed eligibility
                            criteria; and
                      (ii) the period of at least 30 business days (the
                           consultation period) during which the submissions
                           may be made.
          (2)   The chief executive must keep the information mentioned in
                subsection (1) on the department’s website for all of the
                consultation period.
