INFORMATION REQUIRED
The information requested is set out below:
Issue – use of proposed structure
The proposal outlined in the application material suggests the new building will be used as a secondary dwelling. However the site plan suggests it will be used for farm stay (short term accommodation).  Clarification is sought with regard to how the dwelling will be used.
Please note that AO4.2 of the Home Based Business code allows a home based business (for accommodation) to have limited facilities for preparing food and beverages and no laundry and corresponding PO4 (b) does not allow guest accommodation to be self-contained. The proposed dwelling is completely self-contained and has a kitchen and laundry.
Further, PO3 (b) of the Low Density Housing code seeks that a secondary dwelling contributes to housing choice for members of one household.  The definition of:
household means 1 or more individuals who—
live in a dwelling with the intent of living together on a long-term basis; and
make common provision for food and other essentials for living.

Information Required
Clarify what the new dwelling will be used for and amend the application where necessary.

Issue – gross floor area
The proposed ‘secondary dwelling’ is approximately 75m2 in size.  Acceptable outcome AO3 of the Low Density Housing code allows a maximum of 65m2.
Information Required
Provide justification for the need for the non-compliance for a dwelling over 65m2 and demonstrate compliance with PO3 of the Low Density Housing Code.

Issue – Effluent disposal
The proposed dwelling will require an effluent disposal system and it is noted the siting of the dwelling is located in close proximity to the riparian buffer area.  Water quality in this location is to be preserved.
Information Required
3.	Provide details for the siting of the effluent disposal area, ensuring there is sufficient setback to the riparian buffer area.
