Rural Residential Zone Code
The proposed Dwelling House does not comply with the following Acceptbale Outcomes of the Zone
Code:
• Acceptbale Outcome AO6.4 – reduced side boundary setbacks
• Acceptbale Outcome AO11.3 – cut or fill greater than 1.5m in depth to natural ground level
The proposed development is considered to comply with the corresponding Performance Outcomes of
the above-mentioned benchmarks, as demonstrated below.
Acceptable Outcome AO6.4 - Reduced side boundary setbacks
Acceptbale Outcome AO6.4 requires building and structures to be setback 10 metres from the side and
rear boundaries of the site, due to the lot exceeding 1ha in size. It is proposed to provide reduced side
boundary setbacks of 6.1 metres to the north, 6.2 metres to the south and 8.9 metres to the west. It is
noted that, should the lot have been less than 1ha in size, the side and rear setbacks would comply being
greater than 6 metres. Further, the proposed setback to the rear boundary is greater than 10 metres.
The reduced setbacks are largely based on the need to position the Dwelling on the flattest section of
the site, which is positioned on the western end of the lot and orientated north to south across the
narrowest section of the lot. As shown in Figure 6 below, two (2) corners of the Dwelling House and part
of the garage wall encroach in the 10m setback. These are minor encroachments and will not impact the
amenity of the neighbouring properties.
Figure 6 Side Setback Encroachments (Reitsma & Associates, 2023)
As notated on Sheet 20 of the Building Design Plans in Attachment 1, the neighbouring Dwellings are
suitably setback from the proposed built form as follows:
• 21.36 metres to #401 Sunrise Rd (north)
• 51.72 metres to #67 Regency Rd (south)
