Hi Patrick,
 
We have just received Council’s fee email for this application.  The fee outstanding is $22,824.  
 
This is based on the use being impact assessable and inconsistent and then applying a 25% discount for the use being within an approved building.
 
The fee is exorbitant and could not be justified on any rational basis.  In accordance with s97 of the Local Government Act, development application fees are supposed to be levied on a cost-recovery fees.  S97(4) states that a cost-recovery fee must not be more than the cost to the local government of taking the action for which the fee is charged.
 
The application is for a 33m2 ancillary tasting bar within an approved industrial building.  
 
Instead of charging the base fee which is equivalent to 100m2 of bar area.  The charge should be calculated on the basis of the actual 33m2 proposed.
 
This would equate to $10,144 / 100m2 = $101.44 per m2 of GFA
 
$101.44 x 33m2 = $3,347.52
 
$3,347.52 x 3 (being inconsistent) = $10,042.56 – 25% = $7,531.92
 
Please urgently confirm.
