CHANGE APPLICATION UNDER SECTION 78(1) OF THE PLANNING ACT 2016
AMENDMENT OF MATERIAL CHANGE OF USE DEVELOPMENT PERMIT
468 MCKINNON DRIVE, COOROIBAH (LOT 2 ON RP214534)
We act for Sunshine Butterflies Inc., and refer to the material change of use development permit
referenced above and dated 19 December 2016 (“development permit”).
On our client’s behalf, we give notice under Section 78(1) of the Planning Act 2016 (“the Act”) of a minor
change to the development permit. We will arrange for the applicant to pay the applicable Council
fee upon receipt of Council’s invoice and payment instructions.
A completed Planning Act Form 5 is contained in Appendix A. As this application is made by the owner
of the subject site, a landowner’s consent declaration is not required.
The over-arching purpose of the minor change is to enable to inclusion of an ancillary cafe within the
site (as described above) and the approved development. The proposed cafe is to be entirely ancillary
to the existing, approved use of the site, in that it will be restricted to serving the refreshment needs of
on-site staff and clients of Sunshine Butterflies Inc., only. The proposed ancillary cafe will not be open
to the general public.
The proposed changes to the development permit are detailed below:
1) Amend Condition 1 of the development permit to include additional plans in the schedule of
approved plans listed in the condition. The amended schedule of approved plans is to be as follows:

Copies of the additional plans referred to in the above, amended schedule are contained in
Appendix B
2) Amend Condition 2 of the development permit to replace the second sentence with a new sentence,
worded to permit an ancillary cafe as proposed herein. It is proposed that the amended Condition
2 is to provide as follows:
2. The approved use is Wellbeing Type 2 - Social being fora respite centre for people living with
disabilities and their families and associated ancillary office and agricultural uses. The
approval includes an ancillary cafe (serving only the needs of staff and clients of the approved
use, and not open to the general public).
This is a minor change, as defined, as it will not:
Result in a substantially different development;
include any prohibited development;
trigger any changes to referral requirements; or
trigger a requirement for public notification.
The proposed change will not result in a substantially different development as:
There will be no change of use;
the development will not involve a new parcel of land;
the built form will not change dramatically;
there will be no significant change to the intended operation of the approved use;
no integral component of the approved use will be removed;
no additional traffic will be generated and there will be significant impact on traffic flow or the
transport network;
there will be no new or increased impacts associated with the proposed development;
no incentive or offset components are applicable; and
there will be no significant impact on infrastructure provision.
In accordance with the requirements of Section 80(1) of the Planning Act 2016, this minor change
application has been forwarded to the State Assessment and Referral Agency via MyDAS2.
