PROPOSAL
The applicant seeks a two (2) year extension to the currency period. The extension is requested because the applicant suggests that they could not act on the approval on the proviso that COVID significantly impacted their business and equity was not available to act on the approval.

background
A development approval for a Duplex Dwelling (MCU16/0139) was issued by Council on 3 February 2017. The original application was code assessable and did not require public notification.

assessment
The applicant has requested an extension to the currency period to the development approval under section 86 of the Planning Act 2016.
The key development parameters of the development are provided below:
Criteria	Superseded Planning Scheme	Proposal	2020 Planning Scheme	Complies
Population density	9.86 persons max	6.6	NA
Gross floor area 0.45:1	443.7m² max	443.7m²	NA

Landscaped open space	264m² 158m² soft landscaping	371m² 311m²	392m2	x

Length of wall	15 metres max	Complies	15m max
Carparking	1 covered space per dwelling 1 visitor space per dwelling	4 covered spaces	2 covered + 1 additional
As per the assessment of the proposal against the superseded planning Scheme and the current Noosa Plan 2021, the key built form requirements for Duplex dwellings in a Medium Density Residential Zone remains largely unchanged. The landscaping provision has however been amended with the gazetted Noosa Plan 2020. The proposal, superseded Planning Scheme and current Planning Scheme provisions with regards to landscaping are highlight in red above. Any assessment of the landscaping shortfall is provided below.

Landscaping
The development was approved with a total landscaped area of 371m2 which equates to 38% of the total site area. The Noosa Plan 2020 requires a total landscaped area equivalent to 40% of the lot area.
Although the development represents a shortfall of 2% under the current Planning Scheme provision, the proposed development still positively contribute to the visual amenity and natural landscape character of the street and surrounding area. The development is well buffered from adjoining dwellings and provides wide landscaped buffer along the southern, eastern and north lot boundaries. Existing street trees are retained and privacy is addressed.
The shortfall of 2% is no considered significant and the development still align with Performance Outcome PO10 of the Medium Density Residential Zone Code.
Proposal plans are provided below.

Engineering Assessment
Council’s development engineer confirms that the engineering conditions in the original approval are still relevant. Council’s development engineer is supportive of the requested 2 year extension to the planning approval. It is also noted that the conditions call for subsequent OPW.

conclusion
The proposed development still demonstrates compliance with the current Planning Scheme requirements (where they have been varied from superseded Scheme). The 2 year extension request is supported based on the grounds detailed under the assessment section of this report.
