MCU15/0052 - Information Request
Officer :Glen Conforti Direct Telephone: 07 53296241 Our Reference :MCU15/0052 Your Reference :na 1 July 2015 Pacific BCQ PO Box 1901 NOOSAVILLE BC QLD 4566 Dear Sir/Madam Information Request Sustainable Planning Act 2009 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No: MCU15/0052 Proposal: Development Permit for Material Change of Use of Premises - Home-based business Type 2 Street Address: 20 Juniper Ct PEREGIAN BEACH QLD 4573 Real Property Description: Lot 468 MCH 4837 Planning Scheme: The Noosa Plan (16 September 2013) information required The information requested is set out below: Issue Specific Outcome O44 of the Business Uses Code requires that home based businesses have a minor impact to the amenity of the area. Specific Outcome O44 is provided below: Extent of use and residential amenity Specific Outcome O44 “The Home-based business operates such that the level of impact of the business is minor having regard to the amenity of the area”. Council has concerns that because the business is located in a quiet cul-de-sac where there are currently limited traffic movements, the business has more than a minor impact to the amenity of the street. The part of street between Paldao Rise and the Juniper Court cul-de-sac would normally attract around 30 vehicle movements per day (10 per dwelling). It is understood that 1 practitioner would see up to 12 persons per day, which equates to an additional 24 traffic movements per day, around an 80% increase in traffic in the street. Furthermore, additional traffic would be generated on the half days when a second practitioner operates, which could further increase traffic movements by 100% of the average vehicle movements. The additional traffic movements are significant for a quiet cul-de-sac street and therefore the business is considered not suitable for the proposed location and the application is unlikely to be supported. The following 2 options are provided for consideration: Provide any further information that would support your application and request the application be decided. A report with a staff recommendation would then go through the Council meeting process and ultimately be decided by the Councilors, or alternatively; Withdraw the application (subject to a 60% refund of fees paid) End of Information Request Under the provisions of the Sustainable Planning Act 2009, you have three options available in response to this Information Request. You may give the assessment manager (in this instance Council) and each referral agency (if any): all of the information requested; or part of the information requested together with a letter asking the assessment manager and each referral agency to proceed with the assessment of the application; or a letter; stating that you do not intend to supply any of the information requested; and asking the assessment manager and each referral agency to proceed with the assessment of the application. Please be aware that under Section 279 of the Sustainable Planning Act 2009, the applicant must respond to the Information Request within 6 months of the request or otherwise, the application lapses. A response to the above is required to be submitted, prior to further assessment of the application. If any further matters arise as part of assessment of this application, you will be advised accordingly. Council prefers that all the information requested be submitted as one package. A preliminary assessment only of the application has been undertaken and during the formal decision stage, or as a result of public exhibition, other matters may arise. You may wish to follow the progress of this application online at www.noosa.qld.gov.au . The “PD Online” page can be accessed via "Quick Links" on the left hand side of the screen. A disclaimer will appear; upon clicking “agree”, a search for a development application or property address can be carried out. Should you have any further queries in relation to the above, please do not hesitate to contact Glen Conforti on the above number.
