KHA DEVELOPMENT MANAGERS – 15354 November 2015
Reconfiguring a Lot Code – O1 – S1.1 – Lot Sizes and Dimensions
Alternative Solution:
In accordance with Table 14-68 of the Reconfiguring a Lot Code, the minimum lot size in the Semi-
Attached Housing Zone in the Noosa Heads Locality is 800m 2. One of the existing lots does not however
comply with this minimum and is 666m2. The development is for a boundary realignment only and does
not change the size of the combined area of the site nor increase the number of lots. The proposed
boundary realignment increases the current lot size minimum and will provide similar lot sizes to ensure
the proposed lots are of sufficient size and dimension to accommodate one Multiple Housing Type 2
Duplex on each allotment. The boundary alignment allows for residential development to be provided with
a house site area of not less than specified in Table 14-69 of the Reconfiguring a Lot Code.
As demonstrated by the attached plans the proposed buildings are appropriately sited, responds to the
environmental qualities of the site, is consistent with the physical capabilities of the land, does not propose
earthworks, can achieve appropriate setbacks for resident privacy and access, provides private and
communal open space areas, provides adequate access and car parking, and will be responsive to climatic
conditions.
6.5 PLANNING SCHEME CONFLICTS
The assessment of the proposed development against the Noosa Plan 2006 has determined that the only
potential conflict with the planning scheme is with specific outcome O7 of the Noosa Heads Locality Code.
This specific outcome relates to building height within the Semi-Attached Housing Zone. While the
residential units exceed the maximum number of storeys, the proposal does not offend the other
provisions of relevance in the Noosa Heads Locality Code and does not exceed the maximum height in
metres.
In the circumstances, it is suggested that to the extent that there is any conflict with the planning scheme
it must be minor or of a technical nature only. Despite this, the following are planning grounds that are
sufficient to overcome any conflict:
Whilst the development exceeds the maximum 2 storey limit, it does not exceed a maximum
height of 8m;
Banksia Avenue terminates in line with the southern boundary of the site hence the
development will not be exposed to passing traffic or pedestrians;
The proposal respects the natural topography of the site. The development presents as 2
storeys from Grant Street being the primary street frontage;
The adjoining site to the south comprises a dense vegetation buffer and the proposed
development will not impact on this site.
The building height is consistent with structures of adjoining and surrounding land, does not visually
dominate the street or surrounding spaces, preserves the amenity or surrounding land, respects the scale
of surrounding vegetation, responds to the sites topography and maintains a mature vegetated skyline as
intended by specific outcome O7.
