4.5.1 Setbacks
While the setbacks are commensurate with that required for a multiple dwelling in the MDR, the side
setbacks do not meet the Acceptable Outcome of 3m for a side setback within the Community
Facilities zone.
PO10 of the CF and PO12 of the MDR generally reflect the same provisions requiring that building
setbacks do not unreasonably obstruct views, cause overlooking, preserve existing and allow for
new vegetation and be consistent with the predominant character in the surrounding area.
The proposal complies with the PO10 of the CF and PO12 of the MDR for the following reasons:
• The proposal provides good separation between land uses with all side boundaries providing
a minimum of a 1m wide garden which allows sufficient space for vegetation to mature;
• 2 of the buildings are single storey and therefore with no upper level, no overlooking can occur;
• Given 2 of the 3 buildings are single storey, no additional shading will occur when compared
to that of a 2 storey building setback 3m;
• Types C & D building, while 2 storeys, bedrooms are located to the south side and high level
windows to the north side;
