The information requested is set out below:
Issue
The application material does not address the potential amenity impacts of the development, noting that Performance Outcomes PO11 – PO16 of the Business Activities Code specifically address Amenity and Safety.
Information Required
Assessment of the proposal in light of the Amenity and safety Provisions within the Business Activities Code. In this regard, any proposed outdoor music should be supported by an Acoustic Report which includes recommendations on how potential amenity impacts on the residential properties to the north and north-east are to be mitigated.
Issue
The provided plan details the area proposed to be used for outdoor dining however does not include detail of any associated landscaping structures etc. It is noted that Performance Outcome P08 of the Business Activities Code seeks that outdoor dining areas include soft landscaping. This is also reflected in PO26 and PO35 of the Major Centre Zone Code.

Information Required
Detail of the infrastructure to be located in the outdoor dining area – including lighting, landscaping and landscaping structures.
