BACKGROUND:
A Development Permit for Material Change of Use of Premises - Detached House was issued on 22 October 2015.  A report on the detached house application was considered by Council at the General Committee meeting on 19 October 2015 due to height and building setbacks.  The proposed dwelling included 3 storey portions, with the block sloping steeply seaward.

Council issued a Preliminary Approval only, with Condition 1 of the approval requiring the footprint (site cover) of the house be reduced from 40% to 35%.

The applicant made representations to the development approval conditions on 5 November 2015.  The representations seek approval of amended plans to meet Condition 1 of the preliminary approval in order for a full development permit to be issued.

ASSESSMENT:
An assessment in relation to each of the submitted representations is provided below.

Condition 1 – Amended Plans
Prior to the issue of a Development Permit, the Site Cover of the detached house must be reduced to a maximum of 35%.

Applicant’s Representation
…attached amended plans that have reduced the site cover of the building to 35%.
The proposal now complies with the condition of approval and the applicant requests that a Development Permit for the dwelling be issued.

Assessment of Representation

The amended plans have reduced the building length by 2.4m and its width by 0.6m.  Site cover has been reduced by approximately 24m2 down to the required 35%.  The amended plans meet the requirement of Condition 1 and the condition can be deleted and the preliminary approval changed to a full development permit.

Recommendation
It is recommended Condition 1 be deleted, Condition 3 be amended to approve the new plans and a full development permit issued.

RECOMMENDATION

AGREE to the representations submitted in relation to Application No. MCU15/0070, situated at 38 Park Cres SUNSHINE BEACH  QLD  4567 , and issue a Negotiated Decision Notice in accordance with the following:-

A.	Change the approval type to a Development Permit for Material Change of Use of Premises - Detached House

B.	Delete Condition 1

C.	Approve a change to condition 3.
