Dear Patrick,
INFORMATION RESPONSE - DEVELOPMENT APPLICATION FOR A
MATERIAL CHANGE OF USE (HOME BASED BUSINESS BED AND
BREAKFAST) AT 7 BERRIMA ROW, NOOSA HEADS (LOT 132 ON
RP88934)
Further to Council’s Information Request issued 5 May 2021, we now respond in full to each of
the items raised.
Please find below the response to each of the items raised by Council:
Item 1
Provide the required number of spaces.
Response: It is noted that Council’s information request requires 2 car parks for the house, 1
car park for second dwelling and 1 car park per bedroom (i.e. 5 total). The house was approved
under the superseded Noosa Plan 2006 that only required 1 car park. The secondary dwelling
under both the superseded and existing planning scheme only requires 1 carpark. In light of
this, we propose the following in relation to car parking:
● 1 covered parking space can be allocated for the primary house (which only has
1-bedroom);
● 1 covered parking space for the secondary dwelling (which also only has 1-bedroom);
● 1 open car park for the two rooms plus additional parking in tandem on the driveway
(keys of the car are to be left with onsite resident (host) should tandem park be
required by a guest);
● 2 motorbike / scooter parks to supplement the development; and

● If required by Council, an additional driveway could be conditioned to allow a dedicated
parking bay for the secondary dwelling (note we don’t believe this is reasonably required
for a 4-bedroom house being run at a home hosted bed and breakfast).
Further to the above performance parking solution, in accordance with AO6.2 of the Driveways
and Parking Code, where appropriate, motorcycle spaces can be provided on site in lieu of
required car parking spaces at the following rates:
● 2 motorcycle spaces provided for 0.5 car parking space; or
● 4 motorcycles spaces provided per 1 car parking space; and
● up to a maximum of 4 car parking spaces.
The proposal can also accommodate this as an alternative option to supplement overall parking.
In summary, the 1 bedroom secondary dwelling has a dedicated covered park, the 1 bedroom
primary dwelling has a dedicated covered park, and the two home hosted accommodation
rooms have 1 outdoor park with provision for an additional bay in tandem if required + two
motorcycle motorcycle parks are also proposed to supplement the overall parking provision.
In addition, Council has the option to condition an additional driveway and dedicated parking for
the secondary dwelling if considered necessary.
To put the parking provision into context, the 4 bedroom house achieves 3-4 car parks + 2
motorcycle parks. Whereas a 6 bedroom duplex only requires 3 parks and a 6 bedroom triplex
only requires 4 car parks. Further to this, a 4 bedroom short term accommodation house only
requires 2 car parks. The proposed car parking is considered sufficient to satisfy the
development under a performance solution and if further parking is required Council can
condition additional driveway works and a dedicated park for the secondary dwelling.
Item 2
Provide swept path plans demonstrating how vehicles will enter, access the parking
and then exit the site. Please note the vehicle paths must assume that the other
spaces are occupied.
Item 3
Sight lines and potential for conflict for vehicles entering and exiting the site noting
that an existing retaining wall and steep slope of the driveway are likely to impede
sight lines for vehicles entering and exiting the site.
Response: The site is currently functioning now for residential purposes both short and long
term. The site is allowed to be used now as of right for short-term accommodation in an
existing building which is the applicant’s principal place of residence, for no more than 4
occurrences in a calendar year, and for a total of no more than 60 nights in any calendar year.
Providing swept paths is considered onerous in this instance and the house has been
successfully operating as both short and long term accommodation for over 12 months with no
change to the number of bedrooms proposed.

Item 4
Clarification that all works, including landscaping, required by RAB18/0152 have
been completed.
Response: The RAB approval is a separate matter not relating to this application. We request
that appropriate conditions are applied to address this item to ensure compliance is achieved
across both approvals.
We thank Council on behalf of the applicant for assessing the attached additional application
material.
Based on the information provided in this application we respectfully request that Council
proceed to issue an approval.
Should you have any questions with respect to the above, please do not hesitate to contact the
undersigned.
Yours faithfully,
Adapt Town Planning + Development Management
