2 PLANNING & ENVIRONMENT COMMITTEE MEETING REPORT – 10 NOVEMBER 2020
4 PLANNING APPLICATIONS DECIDED BY DELEGATED AUTHORITY FOR SEPTEMBER
2020
In accordance with Chapter 5B of the Local Government Act 2009, Cr Wegener provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Wegener inform the meeting that I have a declarable conflict of interest in this matter in relation to
the application by Sunshine Butterflies as on 23 October 2020 I provided them with a donation of
surfboard making equipment valued at approximately $1200. Although I have a declarable conflict of
interest, I do not believe a reasonable person could have a perception of bias because I do not have
any other association with that organisation and the decision that Council is being asked to make in
regard to this application is not to approve or reject it, it is to only note the decision that has already
been made by Council staff. Therefore, I will choose to remain in the meeting room. However, I will
respect the decision of the meeting on whether I can remain and participate in the decision.
In accordance with Chapter 5B of the Local Government Act 2009, Cr Lorentson provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Lorentson, inform the meeting that I have a declarable conflict of interest in this matter in relation
to the applications by Teatree Property Pty Ltd and Belmondos Pty Ltd. I have a personal relationship
with the Director of Teatree Property Pty Ltd, Mark Bain and the Bain family. The Bain family are friends
of mine and we have attended social events together, our children attended school together and they
surf together as part of the Noosa Boardrider's Club. During the 2020 election campaign, Mr Bain
appeared in one of my campaign videos and agreed to one of my election signs being placed at the
Petrol Station located on Gympie Terrace of which Mr Bain was the property landlord. In relation to the
application by Belmondos Pty Ltd, during the 2020 election campaign, Ryan Taylor, whose family own
Belmondos Pty Ltd, agreed to my election material being displayed at their business, Cafe Le Monde.
Although Mr Taylor is not a personal friend of mine, I know him through our involvement with the Noosa
Boardrider's Club. As a result of my conflict of interest I will now leave the meeting room while the matter
is considered and voted on.
Council Resolution
Moved: Cr Stewart
Seconded: Cr Wilkie
That Council note the declarable conflict of interest by Cr Wegener and determine that it is in the public
interest that Cr Wegener participates and votes on this matter because Council believes that Cr
Wegener does not have a close association with Sunshine Butterflies and given Council is not required
to approve or reject the application, only note it, a reasonable person would trust that the final decision
is made in the public interest.
Carried unanimously.
(Cr Wegener did not vote on the above motion)
Council Resolution
Moved: Cr Wilkie
Seconded: Cr Stockwell
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 10 November 2020 regarding planning applications
decided by delegated authority for September 2020.

Geotechnical Stability
7. A footing system and erosion protection system must be designed to withstand the short-
term erosion associated with a 500-year average recurrence interval storm event
combined with shoreline recession due to sea-level rise for 2100 climate change.
The short-term erosion associated with a 500-year average recurrence interval storm
event combined with shoreline recession due to sea-level rise for 2100 climate change
to be considered for the design of stabilisation measures must be that shown on Figure
8-3 of the 2019 Omtrek report “Working Notes: Mason v Noosa Shire Council - 54
Seaview Terrace, Sunshine Beach”, (Reference J0033 R1, 11 May 2019).
8. The footing system and erosion protection system must in accordance with the works
detailed in the Tectonic report “Geotechnical Investigation, 54 Seaview Terrace,
Sunshine Beach”, (Reference 19078-003-Rev 0, 17 July 2020) and other supporting
documents referenced in the Tectonic report.
9. The design must include the protection of the northern and southern boundaries of the
site to prevent erosion on neighbouring properties exposing the side boundaries of the
site to erosion. The minimum extent of the side boundary protection must be determined
by a line drawn at 28° extending upwards to the west from the base of the rear point of
the erosion shown on Figure 8-3 of the 2019 Omtrek report “Working Notes: Mason v
Noosa Shire Council - 54 Seaview Terrace, Sunshine Beach”, (Reference J0033 R1, 11
May 2019).
10. The design must be accompanied by certification by a Registered Professional Engineer
of Queensland (RPEQ) specialising in geotechnical engineering that the design is
satisfactory and will provide a long-term factor of safety concerning slope stability of no
less than 1.5.
11. Following construction, certification must be supplied to Council by an RPEQ specialising
in geotechnical engineering that the works have been constructed under the approved
design.
12. A dilapidation survey shall be carried out of all adjacent properties before the demolition
of the existing dwelling on the site.
13. Due to the risk of instability on the existing dune slope and the potential for settlement of
loose sand on the adjacent properties, vibrations shall be kept to a minimum and shall
be monitored during the construction of the Detached House. Driven piles (both sheet
piles and pile footings) are not permitted on the site.
14. Landscaping at the rear of the property and the crest of the existing dune slope shall be
limited to a maximum surcharge of 5kPa unless a site-specific slope stability analysis is
carried out to demonstrate that higher loads are acceptable.
15. Under no circumstances shall building materials be temporarily stockpiled in the area of
the crest of the existing dune slope or on the slope.
16. Discharge of concentrated stormwater flows onto the dune slope shall be avoided, and
under no circumstances shall subsurface disposal of water be permitted using infiltration
pits.
17. Stormwater runoff from gutters, down-pipes, driveways, and paved areas shall be
collected and directed by pipes into the Council stormwater system along Seaview
Terrace. Where this is not possible, surface water should be directed to infiltrate into
the ground around the edges of hard surfaces, with infiltration areas set back as far as
possible from the crest of the dune slope.
Section 21
ORDINARY MEETING MINUTES 19 NOVEMBER 2020
18. The existing dune slope and any areas disturbed by the construction of the proposed
development shall be revegetated as soon as possible to reduce the potential for erosion.
Earthworks
19. Earthworks required on-site must be carried out under Council’s Planning Scheme Policy
PSP5 Engineering Design Standards, so as not to cause the additional ponding of water
on any adjoining lands or concentrate or direct overland flow on to an adjoining property.
Coastal Protection
20. A mix of native endemic coastal vegetation consisting of ground covers, shrubs and trees
shall be planted for the width of the property, from the edge of the dwelling to the seaward
boundary. The landscaping works is to be consistent with Planning Scheme Policy PSP3
- Landscaping Plants and Guidelines. The planted vegetation must have a minimum pot
size of 200mm and must be planted at the following density:
a. trees must have a maximum spacing of 5m;
b. shrubs must have a maximum spacing of 1.5m; and
c. ground covers planted between the trees and shrub stems from providing dense
coverage.
The development is to provide adequate landscape buffering to protect the character of
the beachfront, to the reasonable satisfaction of the Manager Development Assessment.
Pedestrian Access
21. A pedestrian access gate must not be installed along the seaward property boundary
with direct access by residents to the beachfront area not being permitted.
Significant Weather Event
22. Should a significant weather event occur which results in substantial erosion within the
site, and undermines the structure and/or renders the Detached House uninhabitable,
the owner must
22.1 Immediately secure the perimeter of the property to prevent unauthorised access
and then undertake necessary works upon the land to make the detached house
safe and suitable for habitation in a timely manner.
a. Any work proposed must be designed to ensure that the work will not cause
adverse impacts on other lands or on coastal processes.
b. Rock, concrete and like hard materials must not be used for the construction
of beach protection works.
c. Any work proposed to be carried out must undertaken in accordance with a
Development Permit for Operational Works.

ORDINARY MEETING MINUTES 19 NOVEMBER 2020
ATTACHMENT 2
To Mayor Clare Stewart,
Councillors Wilkie, Finzel, Lorentson, Stockwell, Jurisevic and Wegener.
Undersigned is over 180 residents of Bushlands and Doonella estates who want
and need another exit besides the two into the congested Beckmans Road.
This petition seeks to build a short (150m) two-way, or even one-way outbound
road between the wide Bushlands Drive through the north-eastern side of
Bushlands Park beside the businesses, to join Gateway Drive opposite the trades
entrance of Bunnings.
As Councillors will know, during the Council and State elections the road outside
the polling booths
becomes very congested, especially during school times!
Council has successfully built roads over low areas like McKinnon Drive, past
Yellowood Close, and Butler Street joining McKinnon Drive to Poinciana Ave. This
section of road, joining Bushlands to Gateway is shorter, and, with fill and
drainage pipes should be successful in providing an alternative exit.
Lastly, residents want, and may need, a quick, accessible exit when needing to
evacuate in the bushfire season. ;
Yours faithfully,
a LAT

Petition to build a road link from Bushlands drive to Gateway drive
(approximately across 100m of bushland opposite Bunnings trades entrance).
This will provide an alternative access for residents and schoo! traffic and help
decongest Beckman’s road on school mornings.

Re: Treehouse in Lowry Park at the intersection of Paldao Rise and Juniper Crt
We the undersigned support the retention of the treehouse built in Lowry Park at the intersection
of Paldao Rise and Juniper Crt, Peregian Beach and urge the leaders of Noosa Shire Council to
allow the said treehouse to remain in situ. The said treehouse was built (under adult supervision
and assistance) and is used by many local children and is therefore of benefit to the community.
