PROPOSAL
The applicant seeks approval to change to an existing development approval for Road work, Drainage work, Landscaping, Stormwater, Earthworks, Clearing Veg,  Electrical/Telecommunications, Traffic Signage to facilitate the approved subdivision of lot 3.

A development approval for a Operational Works permit was issued on 17th December 2020 for Road work, Drainage work, Landscaping, Stormwater, Earthworks, Clearing Veg,  Electrical/Telecommunications, Traffic Signage.
Further detailed design changes has resulted in the applicant requesting additional earthworks to facilitate stormwater to lots 17, 18, 19 and 21. This report provides an explanation for these changes.

Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development as the changes are minor and facilitate the approved development for reconfiguration of a lot by the provision of stormwater infrastructure to lots 17,18,19 and 21 and necessary earthworks;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.

Development undertaken in accordance with this approval must generally comply with the approved plans of development. The approved plans are listed in the following table unless otherwise amended by these conditions.

Applicant’s Request
The applicant has requested revised stormwater and landscape plans be included in the set of approved plans in order to provide stormwater infrastructure and landscaping to the lots 17,18, and 19. Previously the stormwater was proposed to be conveyed through a swale to the frontages of the lots and this raised concerns the required 6m landscaped frontage would be unable to be provided as required by the court judgement.
Further civil design has resulted in the need for additional clearing of 5m either side of the spine road between lots 3 and 7 and to allow for the Lot 8 stormwater to daylight into the swale drain along Walter Hay Drive.
Assessment of Request
The applicant has provide a piped stormwater system instead of a swale system for lots 17-19. The piped stormwater system is proposed to be contained in a 4m wide easement and can facilitate the provision of a 6m landscape buffer to the lots, through a staggered height planting regime for the width of the 6m landscape buffer. The request can be supported.
The additional clearing for the spine road between lots 3 and 7 is to facilitate batters for approved road formation. This clearing change request is considered reasonable to enable approved road construction.
Additional clearing to facilitate stormwater drainage through OS3 is considered reasonable to allow for a lawful point of stormwater discharge.
