   The application was refused primarily due to the proposed lot boundary traversing through an
   area identified as riparian buffer by the Noosa Plan 2020.
   As a result of Council’s decision to refuse the application, the applicant lodged an appeal to
   the Planning & Environment Court seeking that the application be approved subject to
   reasonable and relevant conditions.
   During the course of the appeal, an aquatic ecological consultant was engaged by Council to
   provide specialist technical input into the proposed development and mediation was attended
   with the Court registrar. Prior to mediation Council’s consultant advised that this is a minor
   waterway that would have ordinarily been subject to a 10m wide buffer being a stream order 1
