Maroochydore in the State of Queensland, appeals to the Planning and Environment Court at
Maroochydore, against certain conditions included in the development permit given by the
Respondent in response to the Appellant’s application for a development permit for a Material
Change of Use-Cultivation Type 2-Intensive (Greenhouse) and development permit for a
Reconfiguration of A Lot (Access Easement) on land at 271 & 305 Lake Macdonald Drive Lake
Macdonald described as Lot lots 1 & 2 on SP 108094 County of March, Parish of Tewantin.

The Appellant seeks the following orders or judgment:

a) the appeal be allowed;

b) the impugned conditions be deleted or amended as set out in this Notice of Appeal;
c) such further or other orders as this Honourable Court considers appropriate;
d) costs.

The grounds of appeal are:

The Land

1) The land the subject of this appeal (the Land):
a) was purchased by the Applicant on 20 December 2013 for cultivation of crops;

b) is located at 271 & 305 Lake Macdonald Drive Lake Macdonald;
c) is described as Lots 1 & 2 on SP 108094 County of March, Parish of Tewantin;
d) is in the Noosa Plan planning scheme area:

(i) in the rural zone;
