OPW15/0044 Information Request
Officer: Mark Lewis Direct Telephone: 5329 6290 Fax: 5329 6501 Our Reference: MLEWIS:OPW15/0044 Your Reference: 14328 27 April 2015 WM Projects Pty Ltd C/- KHA Development Managers PO Box 6380 MAROOCHYDORE BC QLD 4558 [email protected] Dear Sir/Madam Information Request Sustainable Planning Act 2009 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No: OPW15/0044 Proposal: Development Permit for Operational Work (Roadworks, Stormwater, Drainage, Landscaping, Clearing Vegetation & Waterway Barrier Works) Street Address: Sporting Field 35 Mary River Rd & Garnet St COOROY QLD 4563 Real Property Description: Lot 45 USL 31429, Lot 204 MCH 976, Lot 157 MCH 4833 information required The information requested is set out below: Issue The submitted documentation does not provide any details with respect to safety aspects of the proposed culverts. Information Required Provide a risk assessment undertaken by an RPEQ in accordance with Section 12 of QUDM assessing the proposed culverts and specifically considering inlet screens. If necessary, revised engineering drawings and calculations should be submitted to Council with the risk assessment. Issue Certification of the design from an RPEQ (Hydrologist) regarding flooding affects is required. Information Required Provide certification from a suitably qualified RPEQ (Hydrologist) that states that, should the works be constructed in accordance with the submitted plans, the works will: achieve compliance with the higher order conditions be in accordance with QUDM with specific reference to blockage factors, debris barriers etc. Issue The construction of the works will extend into the adjacent playing fields and will also potentially require closing of Garnet Street for extended periods of time. Information Required Provide a preliminary Construction Management Plan that specifically address the following: Traffic Management during all aspects of the construct phase including: A Traffic Management Control Plan Any expected road closures including alternate routes and expected extent of closures. Works programme identifying key components of the works and their respective durations Establishment of a communication protocol with the general public, adjoining owners, emergency services and local businesses Identification of complaint management procedures Details on the location of external fill sites/sources, the haulage route, etc Details of the time frame and construction methods to be used for those works within the playing fields. Please note Council’s preference for timing of the works impacting on the field is to be: after 22 August to allow the soccer club to complete fixtures. completed before the summer soccer season starts in mid-October. kept to a minimum duration. Boundary clearance requirements around the field are 3m from the line marking. The applicant will need to ensure that any works commenced prior to the end of season complies with the buffer requirements. Impacts on the field integrity to be kept to a minimum and full reinstatement of the field to pre-works conditions are completed by the developer. Please note in relation to the proposed continuation of the 4m high back of goal fencing to form a barrier to the western most drain, it is considered that the use of 1200mm fencing similar to the property fencing would be sufficient to secure the drain opening from the playing fields. It is noted that the 4m high fencing requires significant footings and bracing. Whilst Council has indicated their preference in regard to the fencing it is the design engineer’s (RPEQ) responsibility to prepare the final design of the necessary safety fencing. Issue The state Planning Policy Appendix 3 has performance objectives for the management of water quality. It is not clear form the application whether these Policies are met – in particular in relation to how the culverts will change waterway hydrology and peak flows, and the impacts this will have on the creek geomorphology. Information Required Demonstrate how the culverts have been designed to mitigate changes on the creeks hydrology and geomorphology. In particular, demonstrate compliance with Performance Outcome PO6 and PO7 of the SPP Code: Water Quality. Issue The Noosa Plan Sediment and Erosion Control Code require that Development minimises erosion and sediment transport and also that Stormwater is diverted around disturbed areas. The provided Erosion and Sediment Control plan does not clearly demonstrate that best practice sediment and erosion controls are proposed to achieve these outcomes. Information Required Demonstrate that the proposed strategy to manage sediment and erosion control is current best practice and therefore achieves the objective of minimisation of impacts. In particular, demonstrate how the proposed construction strategy for the culverts within the watercourse is consistent with the International Erosion and Sediment Control Association - Best Practice Erosion and Sediment Control Appendix I, Instream Works 2008 End of Information Request Under the provisions of the Sustainable Planning Act 2009, you have three options available in response to this Information Request. You may give the assessment manager (in this instance Council) and each referral agency (if any): all of the information requested; or part of the information requested together with a letter asking the assessment manager and each referral agency to proceed with the assessment of the application; or a letter; stating that you do not intend to supply any of the information requested; and asking the assessment manager and each referral agency to proceed with the assessment of the application. Please be aware that under Section 279 of the Sustainable Planning Act 2009, the applicant must respond to the Information Request within 6 months of the request or otherwise, the application lapses. A response to the above is required to be submitted, prior to further assessment of the application. If any further matters arise as part of assessment of this application, you will be advised accordingly. Council prefers that all the information requested be submitted as one package. A preliminary assessment only of the application has been undertaken and during the formal decision stage, or as a result of public exhibition, other matters may arise. Should any Concurrence Agency make an Information Request, you are reminded of your obligation to provide Council with a copy of the information provided to that Concurrence Agency.
