                                       Attachment A

                             Decision Evidence and Findings

Findings on material questions of fact:
   a) The objective of the Transport Infrastructure Act 1994 (TIA) requires the establishment of
a road regime that is safe and efficient.
   b) Section 62 of the TIA provides for the Chief Executive of the Department of Transport
and Main Roads to make decisions about permitted road access locations between
particular land and a state-controlled road.
   c) The development application (Council reference: RAL22/0034) seeks a Development
       Permit for a Reconfiguring a Lot – (1 into 2 lots).
   d) The proposal includes a new or changed access to Pomona Connection Road, a state-
controlled road under the jurisdiction of the department and is an application under s62A
       of TIA.
   e) Pomona Connection Road is a two-lane rural road with minimal shoulder, sealed with
double white lines only broken for accesses and intersections in this section.
   f) Access to future Lot 2 is proposed via Pomona Connection Road. Future Lot 1 has an
existing driveway to Barina Court, a local road.
   g) Access to a local road won't be available for future Lot 2. The natural terrain limits
alternative access locations for future Lot 2.
   h) Sight distance at the proposed future Lot 2 access meets the relevant requirements for
       the design speed.
   i) There is no crash history in proximity to the proposed access location for future Lot 2.
   j) To minimise the impacts to safety and efficiency on the state-controlled road access to
Lot 2 is required to be supported by a rural driveway standard.
   k) The proposed development can be effectively implemented without significant impacts to
the safety and efficiency of the state-controlled road network with the conditioned access
       requirements.
