GENERAL COMMITTEE MEETING AGENDA 12 January 2015

3.       ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of the
following statutory planning instruments to the extent they are relevant to the development:
•     State Planning Policies;
•     the South East Queensland Regional Plan;
•     State Planning Regulatory Provisions;
• the Planning Scheme for the local government area; and
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Regulatory Provisions
The proposal is for an urban activity within the Urban Footprint and is consistent with the SEQ
Regional Plan Regulatory Provisions
3.3. Statutory Instruments – Planning Scheme
Under The Noosa Plan, the site is located in the Noosa Heads Locality and is zoned Visitor
Mixed Use. In this zone the proposed use of Retail Business Type 2 Shop & Salon is identified
as a consistent use and is required to follow an impact assessment process.
Locality Provisions
The proposed use is consistent with the zoning intent for the Visitor Mixed Use zone and is
similar in nature to the site’s existing use for vehicle hire. Overall, the proposal will complement
and enhance the retail commercial uses in Hastings Street/Noosa Drive by providing a
recreational service for visitors to the Hastings Street and main beach area.

The proposed trailer design is generally satisfactory and is likely to contribute to the street’s
diversity providing it is maintained.
Land Use & Works Provisions
The application has been assessed against the applicable planning scheme Codes, including the
following:
•     Business Uses Code
•     Driveways and Carparking Code
The application has been found to generally comply with all applicable code requirements. The
pertinent issues arising out of the assessment are discussed below.
Issue 1
The Driveways and Carparking Code requires 1 space per 20m2 or part thereof of use area for a
Retail Business Type 2 Shop and Salon. Based on a use area of 0.9m2 this would equate to 0.45
spaces. Overall given the scale and nature of the use, it is considered that the existing parking on
the site is sufficient to cater for any increase in parking demand.
Overlay Provisions
The following overlay codes are applicable to this application:
     • Natural Hazard: Landslide & Flooding Overlay – Area Subject to Minimum floor Height
     • Natural Hazard: Bushfire & Acid Sulfate Soils Overlay – High Potential Acid Sulfate Area
          0-5m AHD
The proposal complies with the requirements of the Natural Hazards Overlay given no building
works or excavation works are proposed.

                                                                                  Page 101 of 147
