PROPOSAL
The application seeks approval for a Material Change of Use for Multiple Housing Type 2 - Duplex for 2 x 4 bedroom dwelling units. Each dwelling unit has a similar internal configuration including 4 bedrooms upstairs and living areas downstairs. Each dwelling includes double garage and pool/recreational areas to the rear. The external appearance of each dwelling unit is however different through the incorporation of an alternative roof form, building material and varying finishes.
A locality and proposal plans are provided below.

Site Description
The subject site comprises a rectangular parcel of land located at 20 Nannygai Street Noosaville and described as Lot 36 on RP63879. The site is relatively level and has an existing dwelling located to the front of the site and a shed to the rear. Amenity landscaping is located along the front of the site with a number of mature trees in the centre.
Surrounding Land Uses
Land uses adjoining comprise of various multiple dwelling developments and a residential dwelling to the west.
assessment
Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017
The Noosa Plan.
The following codes from the Noosa Plan are applicable to this development:
Noosaville Locality Code;
Residential Uses Code;
Engineering Works Code; and
Landscaping Code.
The subject site is located in the Noosaville Locality and is zoned Semi-attached Housing. The proposed use is defined as consistent use and is required to follow a code assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below:
Criteria	Planning Scheme	Proposal	Complies
Population density	8.08	6.6 persons

Carparking	2 covered min 1 uncovered min	4 covered
Roof Form	5 degree roof pitch Eaves to 75% min	7 degrees Eaves >75%
setback
The application seeks approval for a minor setback encroachment to the northern side boundary where a setback of 2.5m is required for the dwelling exceeding a vertical height of 7.5m. The diagram below details the extent of the encroachment in blue which is limited to the eave of the dwelling.
The proposed setback encroachment is considered minor and will not adversely impact on the amenity of the adjoining lot to the north. The building design is well articulated with appropriate mix of materials and finishes and will not present an appearance of excessive bulk. The encroachment is limited to the northern eave and largely comes as a result of the required fill to achieve minimum floor levels.

building height
Probable Solution S8.1 of the Noosaville Locality Code seeks a maximum building height of 8.0m relative to the finished and natural ground level. The maximum height is sought to ensure buildings and structures are low rise and have a visual bulk and architectural scale consistent with structures on adjoining land.
The application seeks approval for a building height of 8.15m in lieu of 8.0m. The extent of the encroachment is limited to the roof form and comes as a direct result of the minimum floor level required in the area. The figure below shows the extent of the encroachment.
The location of the building height encroachments are centrally located on the development along the ridgelines of the roof form. The proposed height will not result in the development visually dominating the street or surrounding spaces. Each dwelling is well articulated with strong design elements to provide visual interest and off set building bulk. The proposed encroachment is unlikely to impact on adjoining lots and raises no concern.

ENVIRONMENTAL HEALTH CONDITIONS
Building Demolition/Removal/Relocation
Where the development involves the removal, relocation or demolition of a building, a Waste Management Plan (construction and demolition) shall be submitted and approved by Council’s Environmental Health Officer prior to issue of a development permit for operational works for demolition, removal or relocation of any building other than a shed.
The purpose of the Waste Management Plan is to facilitate the segregation of waste for the effective reuse and recycling of such materials. Segregated wastes attract significantly reduced disposal fees at the landfill with some items free. Higher gate fees are charged for mixed waste.
Waste Management Plans (construction and demolition) are required to be submitted in accordance with Planning Scheme Policy 11, Waste Management Plans.
Waste storage areas are to provide for adequate separation of all reusable, recyclable and waste materials. These shall be located so that they are convenient and safe to use.
The Plan shall contain the following information:
The site area for the storage and separation of waste is to be shown on the plan drawings accompanying the application.
A waste management table as indicated below is to be completed showing how waste material is to be segregated - recycled – reused or disposed.
Table – Waste Management Table

Pumps
7am to 7pm: Maximum level allowable = background + 5dB(A)
7pm to 10pm: Maximum level allowable = background + 3dB(A)
10pm to 7am: No audible noise.
Assessment and certification is required immediately after installation of the equipment and prior to any occupation of the building. All equipment should be operating at the same time to test the overall noise level created, with the measurement location at either the residential boundary or outside the most exposed part of an affected building - whichever is the closest to the plant/equipment.
The certification must be submitted to Council, which certifies that operational noise from any fixed plant and equipment complies with the requirements of this Decision Notice.

Injunctions may also be issued by the Land and Resources Tribunal, and the Minister administering the ACH Act can also issue stop orders for an activity that is harming or is likely to harm Aboriginal cultural heritage or the cultural heritage value of Aboriginal cultural heritage.
You should contact the Cultural Heritage Unit on 07 3247 6212 to discuss any obligations under the ACH Act.
