PROPOSAL
The applicant seeks approval to change to an existing development approval. The change relates to the proposed stormwater system (within the site and the discharge point) on western boundary adjacent to the southern side of Hofmann Drive

A development approval for Operational Works – Drainage Works, Earthworks, Electrical, Telecommunications, Street Lighting, Landscaping, Roadworks, Traffic Signage, Stormwater and Clearing has been issued with the most recent revision being issued on 11 January 2022.
During the construction of the civil works it was discovered that the originally approved design levels for the stormwater discharge would be below ground level and/or require extensive works within Covenant J and the drainage easement in the “Reserve” to construct a free flowing outlet. The extent of the required design changes have been discussed a number of times during site inspections and a number of versions have been reviewed. The submitted design achieves the required free flowing stormwater discharge while minimising the extent of clearing and other works.
It is noted that the works will require the removal of a small number of trees located either directly in the works area or directly adjacent. In response to Council’s questions regarding the long term viability of the particular trees the applicant has submitted an arborist report that address the relevant trees. Council’s Senior Environment officer has reviewed the report and provided additional conditions

Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
The Noosa Plan 2020.
Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.

Applicant’s Request
The applicant has requested approval for the amended designs but has not specifically mentioned which conditions. It is expected that changes are required to the approved plans table to reflect the amended design
Assessment of Request
Council has assessed the design changes considers that the amended design achieves the necessary stormwater drainage outcomes while minimising the clearing and impacts on Covenant J and the “Reserve”.
Council’s Senior Environment office has provided additional conditions to rehabilitate the disturbed areas to the fullest extent possible.

It is recommended that Condition 1 be amended to read as follows:

Assessment of Request
As a result of the design changes the removal of a small number of trees is required. It is recommended that the following additional conditions be included:

Vegetation removal required for the pipe and headwall works and the swale drain works must occur in accordance with the approved Arborist Report (no. J28316 dated March 2022).
Trees to be removed are required to be offset at a ratio of 2:1 with final planting locations to be determined on site in accordance with Council’s delegate.
Offset replacement planting species must be a mix of species removed during the approved works including; Eucalyptus resinifera (Red Mahogany), Syncarpia glomulifera subsp. glomulifera (Turpentine), Corymbia intermedia (Pink Bloodwood), Eucalyptus robusta (Swamp Mahogany), Melaleuca quinquenervia (Broadleaf Paperbark) and Eucalyptus grandis (Flooded Gum) or other species approved by Council.

Vegetation removal required for the pipe and headwall works and the swale drain works must occur in accordance with the approved Arborist Report (no. J28316 dated March 2022).
Trees to be removed are required to be offset at a ratio of 2:1 with final planting locations to be determined on site in accordance with Council’s delegate.
Offset replacement planting species must be a mix of species removed during the approved works including; Eucalyptus resinifera (Red Mahogany), Syncarpia glomulifera subsp. glomulifera (Turpentine), Corymbia intermedia (Pink Bloodwood), Eucalyptus robusta (Swamp Mahogany), Melaleuca quinquenervia (Broadleaf Paperbark) and Eucalyptus grandis (Flooded Gum) or other species approved by Council.
