Mgr planning advised mininum delegated fee is appropriate.msg
Subject: RE: Assessment Fees for MCU19/0001.01 From: Kerri Coyle Date: 2022-06-27T03:38:32+00:00 To: Antoinette Becker HI Ant, While no change is proposed to council’s approval or the council approved plans, it is important we provide comment on the application in the timeframe as the applicant are suggesting to SARA that they amend the condition to refer to the same plans in council conditions which includes an awning in the road reserve. To support their request to SARA, the applicant is saying the awning could be removed in the future. I think it is important we reiterate to all that it is important for the building design that the awning remain. I do though think the minimum delegated fee is more appropriate then the change fee put to the applicant. Patrick and I decided to apply the minor change fee but we knew they would come back to us. Do not open links or attachments if the email is unexpected or unusual. Good morning Kerri and Ant, I am emailing the both of you in regards to the fees charged for the Pre-Request Response application lodged for 6-10 Diamond Street, Cooroy. A fee of $2,273 seems excessive given no assessment is required by Council. The plans submitted to SARA under a Minor Change application are the plans approved by Council under MCU19/0001. Our application/request to Council on 15 June 2022 is requesting a notice stating Council’s response (approval) of the plans which are proposed and lodged to SARA. Here is the background/history of the development, and why the plans approved by SARA are required to be changed (this info is included in the planning report submitted to Council with the request) ---- * An MCU application was lodged to Council in December 2018. * On 17 July 2019, SARA provided a Response, Approved Plans and Conditions (Appendix A attached). The SARA Response included approval from the DTMR for a Permitted Road Access Location (TMR19-026441). * Following SARA issuing their Response and Conditions, numerous design and plan revisions were made upon the request of Council’s Architectural consultant (Noel Robinson / NRA Collaborative). The changes to the plans generally related to the redesign of the front façade and awning, and streetscape landscaping. * What has occurred is that Noosa Council have approved plans (MCU19/0001) which contradict and do not comply with SARA’s Conditions contained in 1901-9327 SRA. A copy of Council’s approved plans are attached (Appendix B). A Minor Change to the approved plans has been lodged to SARA to formalise the variations between the plans approved by SARA (Appendix A) and the latter plans approved by Noosa Council (Appendix B). SARA’s approved plans are to be amended (to be consistent with Council’s approved plans) so the applicant can progress to OPW. The requirement of a minor change application to SARA is a direct result of Council approving plans which contradicted SARA’s conditions. The applicant has already had to incur the cost of SARA’s assessment fees for the application. It seems unfair that the applicant incur additional fees from Council given the plans approved by Council do not comply with SARA’s conditions, and that no assessment is required by Council – Council do not need to assess Council approved plans. We ask Council to please review the fees charged. We politely request that the fees are waived and Council provide their approval of the submission of the Council’s approved plans to enable SARA to continue their assessment of the Minor Change. Admittedly, Council’s Pre-Request Response Application form was not included in the request on 15 June 2022. Please see attached. Please let us know if you require any further information.
