EXECUTIVE SUMMARY
Not Applicable
RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 7 August 2018 regarding Planning & Environment Court
Appeal No. 2760 of 2018 and agree to defend the appeal.

REPORT
On 19 July 2018, Council at its Ordinary Meeting resolved to refuse to change conditions 1, 2, 8
& 9 of a Development Permit for Operational Works for signage for the Noosa Village Shopping
Centre.
The applicant had made representations to the Decision Notice seeking to allow:
 All 3 pylon signs to be illuminated; and
 Retention of the existing illuminated Woolworths sign and Reject Shop sign.
Council did not agree with the applicant’s representations, refusing to approve the changes to the
conditions for the following reasons:
1. The proposed changes will result in additional signage and illumination of signage contrary
to the Noosa Plan’s Advertising Devices Code.
2. The proposed changes will detract from the amenity and desired character of the area and
                         contribute to visual clutter.
3. The proposed changes are not legitimately necessary to provide directions and/or identify
the businesses location to residents and visitors to the area.
As a result of Council’s decision to refuse the representations, the applicant has now lodged a
Planning & Environment Court Appeal. The applicant seeks that the Court approve this
additional signage.
It is in order for Council to defend the appeal and the recommendation is worded accordingly.
