2. BACKGROUND
24 March 2020 - Negotiated Decision Notice for a Reconfiguring a Lot - Rural Settlement (5 lots
into 16 lots) in a Rural Residential zone each lot contained building envelopes.
The original site was a former clay extraction area with mapped biodiversity, bushfire,
waterbody/drainage, geotechnical and infrastructure constraints. The envelopes ensured each lot
had a defined house site and effluent disposal area while keeping future dwellings clear of
easements, protected vegetation and other constrained land.
The approval conditions specifically required a plan of development showing the building
envelopes, access driveways, vegetation protection covenants, house site areas and effluent
disposal areas.
Conditions (7, 8 & 9) of the approval require each future dwelling to be sited and constructed in
accordance with those approved envelopes and for the Plan of Development to be included in
contracts of sale. The proposed shed is intended to be located outside the approved envelopes
and therefore trigger this minor change to the approval to amend .
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (20 March 2026).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:

Page 6
• the development would not result in substantially different development as the proposal does
not:
o result in the application applying to a new parcel of land; or
o change the ability of the proposed development to operate as intended; or
o significantly impact on traffic flow and the transport network, such as increasing traffic
to the site; or
o introduce new impacts or increase the severity of known impacts; or
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The original application was lodged and assessed under the now superseded Noosa Plan 2006.
Pursuant to s81 of the Planning Act 2017, Council must consider the planning scheme in effect
when the original development application was lodged, however Council may give weight to Noosa
Plan 2020 as the planning scheme in effect at the time of the minor change application being
lodged.
The following codes from Noosa Plan 2020 are applicable to this development:
• Rural Residential Zone Code;
• Low Density Housing Code;
• Works Codes;
The proposed changes are consistent with the planning scheme provisions at the time of the
original approval, as well as the provisions of the current planning scheme.
The following issues from the current planning scheme are applicable to the development.
Rural Residential Zone
The amended proposal now provides a 10.0 metre setback to the eastern side boundary.
Council requested the boundary of the envelope be amended to comply with the minimum side
boundary setback required under the Rural Residential Zone Code. The applicant subsequently
amended the design so that a 10.0 metre side setback to the eastern side boundary is achieved
in accordance with AO6.4 of the Rural Residential Zone Code. No further assessment against PO6
is required.
Applicant’s Request – Condition 2
Approved Plans
2. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
otherwise amended by these conditions.

As annotated by Council
The applicant has requested existing condition 2 be amended to include the updated plans relevant
to Lot 11. In this circumstance the proposed minor change only relates to Lot 11 and therefore a
more appropriate to amend the approval to include an additional condition (Condition 56) which
approves the updated building envelope plan relevant to Lot 11 only.
Assessment of Request
The applicant submits that the proposed shed location is preferred because it is the most practical
having regard to existing site circumstances including access from the existing crossover and
driveway, separation from the onsite effluent disposal area to the west, and use of a previously
flattened part of the site that avoids further earthworks.
It is agreed that the amended location is suitable having regard to established site access, internal
driveways and topography. Development Engineering has also advised that the amended shed
location does not adversely impact overland flow or raise other engineering matters relevant to the
site.
Recommendation
Refuse the request to amend condition 2 and include an additional Condition 56 to read as follows:
Approved Plan - July 2026 relevant to Lot 11 on SP315578
56. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
otherwise amended by these conditions.

4. CONSULTATION
4.1. Referral Agencies

4.2. Internal Council Referrals

The mapped waterway bisecting the proposed shed area is a drainage feature and does not carry
any significant flows. Suggest that the proposal is supported.
5. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 83(9) of the Planning Act 2016.
