2. BACKGROUND
24 March 2020 - Negotiated Decision Notice for a Reconfiguring a Lot - Rural Settlement (5 lots
into 16 lots) in a Rural Residential zone each lot contained building envelopes.
The original site was a former clay extraction area with mapped biodiversity, bushfire,
waterbody/drainage, geotechnical and infrastructure constraints. The envelopes ensured each lot
had a defined house site and effluent disposal area while keeping future dwellings clear of
easements, protected vegetation and other constrained land.
The approval conditions specifically required a plan of development showing the building
envelopes, access driveways, vegetation protection covenants, house site areas and effluent
disposal areas.
Conditions (7, 8 & 9) of the approval require each future dwelling to be sited and constructed in
accordance with those approved envelopes and for the Plan of Development to be included in
contracts of sale. The proposed shed is intended to be located outside the approved envelopes
and therefore trigger this minor change to the approval to amend .
