Koala habitat area (KHA) and Planning Regulation exemptions
1. Based on the information provided, the proposed clearing for a dwelling house, associated
structures and infrastructure and firebreaks on Lot 36 on SP139155, is considered
exempted development as defined in Schedule 24 of the Planning Regulation 2017
(Planning Regulation), and is therefore not considered prohibited development under
Schedule 10, Part 10, Division 3, Section 16A – Development interfering with koala habitat
in koala priority area and koala habitat area of the Planning Regulation.
2. Schedule 24 – Exempted development definition
Exempted development (k):
Assuming the 500m2 offered under item (k) has not yet been used, the proposed
clearing for the dwelling could constitute exempted development under item (k) of the
exempted development definition if the proposed development was slightly reduced
from a 501.4m2 area of impact to 500m2 of impact.
Exempted development (l):
Alternatively, the proposed infrastructure could constitute exempted development using
both items (k) and (l) of the exempted development definition (e.g. the dwelling, pool,
carport and shed could be carried out under (k), the water and septic tanks could be
carried out using (l) (as it relates to non-linear infrastructure) and the driveway could be
carried out using (l) (as it relates to tracks / linear infrastructure).
Exempted development (n)(vii):
The submitted Fire Management Plan recommends two different “necessary firebreak”
widths:
o a 10m setback from any retained vegetation (outlined in 1 Executive Summary of
Fire Management Plan), and
o the following “separation from hazards” distances to achieve BAL 19 (outlined in
Table 9 of Fire Management Plan):
17m – north bushfire attack
20m – east bushfire attack, and
10m – west bushfire attack.
These widths are less than the maximum firebreak widths provided by exempted
development item (n)(vii) and therefore would constitute exempted development.
The proposal described in the information supplied does not constitute prohibited development and
can meet the definition of exempted development under Schedule 24 of the Planning Regulation.
This advice outlines aspects of the proposed development that are relevant from the jurisdiction of SARA.
This advice is provided in good faith and is:
based on the material and information provided to SARA
valid for a period of 9 months unless a change in legislation or policy occurs that affects the advice
not applicable if the proposal is changed from that which formed the basis of this advice.
This advice does not constitute an approval or an endorsement that SARA supports the development
proposal. Additional information may be required to allow SARA to properly assess the development
proposal when a formal application has been lodged.
If you require further information please contact Danika Cowie, Principal Planning Officer, on 07 5352
