RE: Response to Information Request (MCU24/0105) – Dual Occupancy - situated
       at 3 Werin St, Tewantin

Council issued a further information request on 17 September 2024. The following
additional information provides a response to Council’s Information Request items:

   1. Provide a compliant rear boundary setback, revised floor plans are to show
      all boundaries.

An amended plan is provided with an increased rear setback of 6m to the building edge
and 5.4m to the eaves. All other dimensions are included on the plans with compliance to
the building line. This is consistent with the setbacks of the adjoining buildings and does
not result in any loss of views or amenity.

   2. Provide sightline and overlooking assessment between areas of private
      open spaces of adjoining properties.
   3. Provide revised/additional sections to include the adjoining premises-built
form to assist in assessment against Performance outcome PO19.

The roof terraces are proposed within the middle of the building to integrate into the roof
form, as well as prevent overlooking into adjoining properties. A 1.8m roof terrace screen
is provided along the northern edge of the terrace to prevent overlooking of the units
adjoining, while still complying with the minimum roof height provisions. It is noted, the
architectural practice manual seeks for an ‘eye height’ of 1.62m for screening devices.

Detailed section plans with the plots of the adjoining building heights are also included
demonstrating there are no overlooking of adjoining windows or outdoor living areas.

   4. Provide an assessment against the above-mentioned Acceptable outcomes
and amend the design as necessary.

Additional plantation shutter screening devices are provided on two sides of the rear
balcony to ensure no overlooking of adjoining outdoor living areas within 10m. The
shutters are not considered an enclosure of the rear deck, as it will be not certified as a
habitable space and needs to be appropriately waterproofed for outdoor drainage.
Additional conditions may be applied to ensure the space is not enclosed.

   5. Provide revised plans, provide greater articulation to the terrace/deck to
demonstrate the terraces do not contribute to the site’s plot ratio.

The plans have been amended to strictly comply with the birds eye view of the site cover
calculation.

    6. The existing street tree is to be retained, the driveway is to be realigned as
       necessary.
    7. All works proposed to be carried out within the TPZ is to be sensitive to the
adjacent poinciana tree and supported by a qualified arborist.

An arborist report is provided with the response indicating the Poinciana tree may be
retained with the proposed works, subject to some limb trimming and tree protection
signage being installed for the contractors.

    8. Provide revised landscaping plan in alignment with the architectural plans,
in compliance with Acceptable outcome AO10.1 of the Dual Occupancy and
       Multiple Dwelling Code.

An updated set of landscape plans is provided with the application.

    9. Annotate location of waste storage areas on the architectural plans. Please
note the Waste Management Code talks to these spaces being clear of
       carparking bays.

A bin storage area has been relocated to the front of the site and setback 2m from the
street, in accordance with the relevant planning scheme requirements.
