The hilly terrain of the area has resulted in predominantly residential uses, with cattle grazing activities also occurring. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and Noosa Plan 2020. Noosa Plan 2020 The following codes from the Noosa Plan 2020 are applicable to this development: Rural Zone Code; Caretaker’s Accommodation, Dwelling Unit and Rural Worker’s Accommodation Code; Works Codes; Agricultural Land Overlay Code; Biodiversity, Waterways and Wetlands Overlay Code; Bushfire Hazard Overlay Code; Landslide Hazard Overlay Code; and Regional Infrastructure Overly Code. The subject site is located in Lake Macdonald and is zoned Rural. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process. The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Caretaker’s Accommodation AO2.1 of the Caretaker’s Accommodation, Dwelling Unit and Rural Worker’s Accommodation Code requires the following: In the Rural zone, caretaker’s accommodation is: located within 50 metres of the primary use of the site, for which the caretaker is responsible; on a site with a minimum area of 20 hectares, accommodating an existing rural activity; or The corresponding Performance Outcome PO2 requires the following: Caretaker’s accommodation is used for bona fide caretaking or property management purposes such that: in the Rural zone, caretaker’s accommodation is required because of the need to caretake a non-residential activity on site; or The Caretaker’s Accommodation is required as it will be used to managing the bona fide rural activity on the site. The applicant has advised that the “…property usually runs approximately 40 head of cattle. There are 32 weaner heifers onsite at the moment after 20 steers were sold in August, as demonstrated by the Cattle Sale Advice/Invoices attached at Appendix D. As mentioned above, the property owner lives in Brisbane and a full-time caretaker is required to tend to the cattle, fencing and other aspects of the rural activity.” Based on Council’s aerial mapping, it is evident that the property operates an agricultural activity on the site. The land has an area of 31.67 hectares and is zoned rural. An arbitrary impact buffer is provided to the permitter of the vegetation which is mapped over the proposed building site. It is acknowledged that the subject site triggers assessment against the overlay however the works are not located in a medium or high bushfire hazard area and is only sited within the arbitrary impact buffer. Further, appropriate fire breaks have been established between the proposed dwelling and existing hazard vegetation and the Caretaker’s Accommodation will be designed in accordance with the QDC and relevant BAL requirements. Biodiversity, Waterways and Wetlands Overlay It is acknowledged that the site is subject to the Biodiversity, Waterways and Wetlands Overlay Code of the Noosa Plan 2020. The proposed Caretaker’s Accommodation will be sited entirely outside of the constrained areas (including the Riparian Buffer Area) and no vegetation is proposed to be removed. cONSULTATION Referral Agencies Not Applicable Internal Council Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions.
