       4.5.8      Engineering works code

       The proposal complies with the relevant parts of the code for the following
       reasons—
       • it would provide clearly defined car parking, legible traffic paths,
                  throughout the site, and a reduction in access points to the major road
                  network;
       • earthworks would be minimal and mainly restricted to replacing the
                  existing fuel storage tanks. Appropriate soil testing would be undertaken to
                  establish any contamination;
       • an erosion and sediment control plan would be implemented prior to
                  construction; and
       • suitable waste bins would be provided and screened from surrounding
                  development.

       4.5.9      Natural hazards overlay code

       The proposal complies with the code as it would be compatible with the acid sulfate
       and flooding hazards so as not to place people, property and economic activity at
       risk.

       A Flood Information Certificate obtained from Council identifies the flood level at
       2m AHD, with a recommended DFL of 2.5m AHD. However, contour information
       obtained from a detailed survey indicates the site varies between 1.8m—2m AHD.
       The finished floor levels would be lower than the recommended DFL, but the
       proposal would decrease the footprint of the existing development to reduce the
       impacts on flooding. The proposal would be compatible with flooding
       characteristics of the site for the following reasons—
       (1) it would retain the existing primary use of the site and significantly reduce
                  the existing building footprint;
       (2)        it would not introduce dwellings;
       (3) it would not increase impervious areas and stormwater runoff; and
       (4) conditions can be imposed on the location of services and the use of
                  building materials that make the building more resilient to a flood event.
