The adjoining property to the west includes an existing two storey duplex which has kitchen and living areas
located at ground level and two bedrooms on the upper floor as detailed in Figure 1 below. The areas of the
proposed dwelling that may have impact on the adjoining duplex unit relate to the living room and pool located
along the western boundary as detailed in Figure 2. Whilst the kitchen has no windows or openings to the side
boundary, the living room and upper level bedrooms have windows along this façade.
In response to Councils information request, the applicant has modified the design and converted the rear
deck into a living room that is enclosed with a solid wall and louvres to minimise noise impacts. The design of
the building and site incorporates landscaping, fencing and eaves to mitigate noise to adjoining premises.
It is noted that the dwelling is single storied, proposes only three bedrooms and has been purpose designed
to provide a luxury private holiday experience. All service areas and carparking are located underneath the
dwelling to minimise noise impacts and the overall scale of the dwelling is considerably smaller than existing
development in the locality.

and assume the other spaces are occupied.
