RE:     Change Representation to Decision Notice – MCU21/0057 – 28 Eenie Creek
        Rd, Noosaville

On the 17 June 2021, Council issued a Development Permit for Material Change of Use
for Indoor Sport and Recreation. The Decision Notice was emailed on the 21 June 2021.

In accordance with section 75 of the Planning Act 2016, the applicant seeks to suspend
the appeal period (Day 11) and amend condition 5 of the original decision. The proposed
changes to the conditions and comments are provided below.

Condition 5

5. The Pilates studio may operate during the following hours:
    • Monday to Friday: 5:15AM–10:30AM & 4:30PM–6:15PM;
    • Weekends: 7AM – 11AM & 3:30PM – 5:15PM

The applicant seeks to reword the condition as follows (Strikethrough deleted and bold
underlined additions):

5. The Pilates studio may operate during the following hours:
    • Monday to Friday: 5:15AM–10:30AM & 4:30PM–6:15PM;
    • Weekends: 7AM – 11AM & 3:30PM – 5:15PM
    • 5:00AM-9:00PM, 7 days a week

The adjoining development approval MCU17/0555 for the F45 gym is approved to operate
from 5am to 9pm Monday to Sunday. Although the application describes how the current
pilates studio includes current peak hours for classes, the applicant seeks to have the
ability to have classes outside of these times if there is a change in need for times and
demographics, similar to the F45 gym.

The change in condition will have no impacts on carparking demand or amenity, with the
adjoining gym operating at similar times and noise restrictions.
