MAX WATTERSON+ASSOCIATES CONSULTING SURVEYORS & PLANNERS 15" June 2021 Ref: 03/1506 Your Ref: MCU 20/0141 & RAL20/0030 The Chief Executive Officer Noosa Shire Council PO Box 141 TEWANTIN QLD 4565 Attention: Patrick Murphy Dear Sir, Re: Development Application for Material Change of Use and Reconfiguration of a Lot Lot 201 on P5011 1 Rectory Street, Pomona Applicant: Corporation of the Synod of Diocese of Brisbane | refer to the above-mentioned matter and the Decision Notice issued by Noosa Council dated 18" May 2021; and | make the following representations to support a Negotiated Decision Notice. The representations are outlined below: MCu20/0141 CONDITION 6: Screening Prior to the commencement of the use a minimum 1.8 metres high solid acoustic screen fence must be constructed to the southern boundary of proposed Lot 21. The Condition 6 implies that the continued use of the church will create a noise level that requires abatement. The church is currently used for services on Sundays only, at 8:00am for one and a half hours with an average congregation of 15-20 people. The level of noise emitted from the church is within the range of usual residential noise levels. There have been no complaints or comments from adjoining residences during the use of the church. Accordingly, it is requested that Condition 6 is deleted from the Decision Notice. CONDITION 7: Screening Prior to the commencement of the use a 0.6 landscape strip must be provided to the full length of the southern boundary of proposed lot 21. The planted vegetation must consist of native, endemic species comprised of medium and large shrubs with a growth height of less than 3 metres. Condition 7 appears to be imposed to soften the visual impact of the 1.8 metre high solid acoustic screen fence required by Condition 6. Accordingly the deletion of Condition 6 subsequently requires the deletion of Condition 7. PRINCIPAL 12 Maple Street (PO Box 639) Cooroy Q 4563 ABN 59 847 644 252 Max L. RAL20/0030 CONDITION 2: External Works Memorial Avenue must be upgraded for the length of its frontage to the subject site. The works must be undertaken in accordance with an Operational Works approval and must include in particular: a. Construction of a 1.8m wide pedestrian footpath generally in accordance with Council’s standard drawing RS-065; b. Construction of a pram ramp, generally in accordance with Council’s standard drawing $SD:9006. On the SE corner of the subject property’s road reserve, providing connection to existing pram ramp on the opposite side of Rectory St. Condition 2 is imposed pursuant to s145 of the Planning Act 2016 being non-trunk infrastructure. With respect to point a. of Condition 2 it is noted that it is extremely problematic to construct a footpath along the Memorial Avenue frontage due to the existing mature street trees. Please see below a photo showing the location and extent of the melaleucas planted in the verge. The construction of a footpath does not appear possible due to: e There is less than 1.8 metres available between the trees and the property boundary; e There is a significant cross fall on the verge between the trees and the property boundary; and e The trees have significant surface roots within the proposed path area. The construction of the pathway appears only possible with the destruction of the street trees and excavation of the verge. The street trees are a significant and important part of the character of Pomona. The impact upon the streetscape of Memorial Avenue does not appear warranted in this case. With respect to point b. of Condition 2 it appears the requirement to construct a pram ramp is a subsequent requirement of the construction the pedestrian footpath. Accordingly, the deletion of the requirement to construct a pedestrian footpath will delete the requirement to construct a pram ramp. The applicant requests the deletion of Condition 2 of the RAL approval.
