Policy
Nature Are any MSES present ? ☒ YES ☐NO .
Conservation
Act 1992 - Impacts to MSES must be avoided wherever possible.
- Under the Environmental Offsets Act 2014 and Environmental Offsets Regulation
2014, offset requirements may apply to assessable developments where it has
been determined that there will be a significant residual impact on a prescribed
environmental matter.
- A Significant Residual Impact (SRI) Assessment is required to determine whether
residual impacts to MSES trigger significance criteria.
Is the IA mapped as a Protected Plants Flora Survey Trigger Area?
☒ HIGH RISK ☐ NOT MAPPED
- The IA is partly mapped as Protected Plants High-risk area. As such a protected plant
survey of the CIA (IA and 100m buffer) will be required.
Are there any Protected Plants present in the IA or CIA ? ☐ YES ☒NO
- If no listed flora species are found, clearing can occur under Section 45 of the Nature
Conservation (Plants) Regulation 2020.
Animal Breeding Places present ☒ YES ☐NO
- A permit is required to tamper with Animal Breeding Places under the Nature
Conservation (Animals) Regulation 2020.
- To manage impacts to breeding places of Least concern species, works must be
carried out under the Noosa Council Generic Species Management Plan – Low Risk
of Impacts (SMP-Low Risk).
- If impacts to breeding habitat of CREVNT and SLC or colonial-breeding species
including indirect impacts cannot be avoided, a DESI-approved Species
Management Plan – High Risk of Impacts (SMP – High Risk) will be required to
manage impacts to breeding places of threatened or special least concern species.
- The SMP must be implemented during site disturbance in collaboration with the
Fauna Spotter and a register of animal breeding places must be maintained.
Vegetation Regulated vegetation present ☒ YES ☐NO
Management
Act 1999 - The northern edge of the eastern parcel includes a limited area mapped as regulated
vegetation. However, the flora survey found that this area was comprised of young
regrowth, and as such, clearing works associated within the proposed expansion do
not require assessment under the Planning Regulation 2017 and the VMA 1999.
