2.   BACKGROUND

The subject site benefits from several existing approvals, with Development Permit 132007.12.6 being
relevant to the proposed change application.

The development permit for material change of use was first obtained on 7 March 2008 via a
Negotiated Decision Notice for the following uses on the land:

     ▪   Commercial Business Type 1 – Office (Office);
     ▪   Commercial Business Type 2 – Medical (Medical);
     ▪   Education Type 3 – Adult (Education);
     ▪   Retail Business Type 1 – Local (Shop);
     ▪   Retail Business Type 2 – Shop and Salon (Shop); and
     ▪   Entertainment and Dining Business Type 1 – Food & Beverage (Dining).

There have since been a series of change applications, mainly pertaining to:

     ▪   Staging of the approved development (132007.12.02)
     ▪   Extension of the currency period (132007.12.04)
     ▪   Changes to conditions of approval and car parking provision (132007.12.6)

The most current approval (132007.12.6) was originally refused by Noosa Council on 13 July 2015, and
subsequently appealed with the Planning and Environment Court. As mentioned above, the Planning
and Environment Court resolved to approve the change application by judgement made 3 February
2017.

A copy of the judgement and current consolidated conditions of approval is included in Attachment
C.
