1. PROPOSAL
The application seeks minor design amendments to the approved dual occupancy and associated
subdivision, while generally maintaining or improving the approved development envelope. The
proposed changes do not increase setbacks, site cover or overall development intensity and
include a reduction in the approved building height.
Key amendments include:
• Replacement of approved aluminium balustrades with glass balustrades on the first-floor
northern and southern elevations.
• Replacement of louvred windows with glazed windows on the ground and first floors of the
northern and southern elevations.
• Removal of ground-floor louvred windows and replacement with glazed windows on the
first floor of the western elevation.
• Replacement of approved ground-floor windows on the western elevation with a bi-fold
door.
• The maximum building height remains less than 8 metres. stormwater infrastructure to
reflect the updated building design and subdivision configuration.
Overall, the proposal comprises a refinement of the approved architectural design and associated
civil works, with the most notable change being a reduction in building height and updates to the
building façade treatments through the introduction of additional glazing and glass balustrades.
The locality and proposal plan are included below.

2. BACKGROUND
Combined development approvals for Material Change of Use (Dual Occupancy), Operational
Works (Landscaping, Access, Car parking, Earthworks, Stormwater) and Reconfiguring a Lot (1
Lot into 3 Lots) was approved on 15 September 2025.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (Amendment 1 - 25 September 2020).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the proposal does
not:
o dramatically change the built form in terms of scale, bulk and appearance; or
o change the ability of the proposed development to operate as intended; or
o introduce new impacts or increase the severity of known impacts; or
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The original application was lodged and assessed under the now superseded Noosa Plan 2020
(Amendment 1 - 25 September 2020). Pursuant to s81 of the Planning Act 2017, Council must
consider the planning scheme in effect when the original development application was lodged,
however Council may give weight to Noosa Plan 2020 as the planning scheme in effect at the time
of the minor change application being lodged.
The following codes from Noosa Plan 2020 are applicable to this development:
• Medium Density Residential Zone Code;
• Noosaville Local Plan Code;
• Dual Occupancy and Multiple Dwelling Code;
• Works Codes;
• Acid Sulphate Soils Overlay Code;
• Flood Hazard Overlay Code.
The replacement of louvred windows with glazed windows and the use of glass balustrades alter
the external appearance of the building. However, the building remains orientated in the same
manner as approved and privacy screening elements are generally retained. The amended design
produces a reduced bulk and scale impact relative to the approved plans.
Page 6 of 20
Document Set ID: 24926353
Version: 9, Version Date: 10/08/2026
Page 7
No additional overshadowing, overlooking or loss of amenity impacts beyond those already
assessed under the original approval are apparent. The amended design is likely to achieve equal
or improved outcomes relative to the approved development. The change maintains privacy
conditions to ensure that due to the filling on site, upper-level terraces include fixed external
screens.
The proposed amendments are appropriately characterised as a minor change under the Planning
Act 2016 because they:
• Maintain the approved development outcome;
• Do not result in a substantially different development;
• Do not increase development intensity;
• Reduce the approved building height and overall bulk;
• Primarily comprise architectural refinements and related changes to subdivision and
operational works arrangements.
The amended plans identify an overall building coverage of 277.72m² (41.70% of the 666m² site)
using the builder's site coverage methodology. However, an independent assessment of site cover
has been undertaken against the Noosa Plan definition as part of this assessment, which confirms
the development remains generally consistent with the approved development footprint and does
not exceed the maximum 40% site cover requirement. For development assessment purposes,
site cover has been calculated in accordance with the Noosa Plan definition, which excludes
elements not included in the planning scheme definition of site cover.
The proposed amendments do not result in any material increase in the extent of built form on the
site, with setbacks and the overall building envelope remaining substantially unchanged. The
changes are limited primarily to architectural refinements, façade treatments, window and
balustrade modifications, associated subdivision and servicing adjustments, and maintain an
overall building height no greater than 8.0m. Accordingly, the amendments do not increase the
scale, intensity or site coverage of the approved development.
The proposed changes are considered minor in nature and acceptable. The amended plans may
be approved as a minor change subject to the conditions of the existing approval continuing to
apply unless otherwise amended by the decision notice.
