Author Development Planner, Will Koschade Development Assessment APPLICATION DETAILS Application No. MCU21/0094 Applicant Jennifer Maree Rogalsky Proposal Material Change of Use - Dwelling house Properly Made Date 19 May 2021 Information Request Date 16 June 2021 Information Response Date 20 July 2021 Decision Due Date 7 September 2021 Report Completed Date 31 August 2021 Report Reviewed By Patrick Murphy – 31 August 2021 PROPERTY DETAILS Property Address 142 Playfords Rd Kin Kin Qld 4571 RP Description Lot 186 MCH 224 Land Area 634,850m² Existing Use of Land Vacant STATUTORY DETAILS SEQRP Designation Regional Landscape Zone Rural Zone Precinct Not Applicable Local Plan Area Not Applicable Overlays Biodiversity, waterways and wetlands overlay code Bushfire hazard overlay code Assessment Type Code PROPOSAL The application seeks approval for a Material Change of Use - Dwelling house. The application requires approval because the site located within a Biodiversity, waterways and wetlands overlay area. An existing access track has been developed on the site and the proposed dwelling would be centrally located on the western portion of the lot. The locality and proposal plan are included below. Figure 1 – Locality Figure 2 – Site Plan Figure 3 – Floor Plan site details Site Description The site comprises a 63.5ha rural lot that is heavily vegetated. Various waterways are located on the site. With the exception of an internal access track, the site remains undeveloped. Surrounding Land Uses Rural lots adjoin the site to the south, east, west and north. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and Noosa Plan 2020. Noosa Plan 2020 The following codes from the Noosa Plan 2020 are applicable to this development: Rural Zone Code; Low Density Housing Code; Bushfire Hazard Overlay Code; and Biodiversity, Waterways and Wetlands Overlay Code. The subject site is located in Kin Kin and is zoned Rural. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process. The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Biodiversity, waterways and wetlands overlay code The site is wholly located within an area of biodiversity significance and therefore triggers assessment against the code. The Biodiversity, waterways and wetlands overlay code requires that new residential development be sited on a portion of the lot with the least amount of environmental constraint or within existing cleared areas. This is supported by the corresponding Performance Outcome PO1 which requires that development be sited and designed to protect the physical and ecological integrity of ecologically important areas. As shown by the insert below, the site is wholly located within the overlay area and therefore no portion of the lot offers a more suitable building area. The proposed development does however limit the overall footprint and subsequent exempt clearing that may occur for asset protection. The development would also utilise existing internal tracks to avoid additional clearing associated with access. The proposed development avoids clearing as much as possible and limits the overall impacts while still enabling development. The proposal is therefore in keeping with the provisions of the overlay code and is supported. cONSULTATION Referral Agencies The applicant was referred to the following Referral Agencies: Department of Infrastructure, Local Government and Planning (SARA) The Department is a referral agency for Clearing Native Vegetation and Koala Habitat Area in SEQ Region. The Department has responded on 24/08/2021 advising that they have no objections to the proposed development. Internal Council Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
