3. STATUTORY PROCESS
The proposed change to the development approval requested by the applicant is determined to
constitute a permissible change in accordance with S367 of the Sustainable Planning Act 2009
on the grounds that:
The change would not result in a substantially different development as the use remains
the same as that approved. The changes reduce the overall number of units on the site and
slightly increase gross floor area from 17,571 m2 to 18,610m2, though it is noted that the
original approval was approved with a floor area of 21,950m2.
The changes do not trigger a new referral to the State Assessment and Referral Agency.
The original development application was impact assessable and did not attract any public
submissions. The changes do not introduce significant new aspects (such as increases in
height or scale, changes in development footprint or different uses) likely to cause persons
to make submissions on reasonable grounds; and
The changes do not involve prohibited development.
The application was referred to the Department of Infrastructure, Local Government & Planning
to seek its views in relation to the State concurrence agency requirements applying to the
existing approval. The Department responded on 8 September 2016 advising it has no objection
to the changes.
The previous change application was referred to Unitywater because the approval included water
and sewer conditions. Unitywater advised on 20 January 2016 it had no objection to the
proposed changes and that the existing water and sewer conditions could be maintained.
