Attached to the e-mail Iluka Covenant Application to clear vegetation 20 Serenity Close.msg.
Noosa Council Via Email AYTENTION: MICHAEL CANTORI / CONNOR NEVILLE RE: ILUKAAPARTMENTS CTS 45015, 10, SERENITY CLOSE, NOOSA HEADS. Dear Sirs, Please find attached an application to clear vegetation. As you are aware there is a Fire Management Plan (FMP) in place for the above property which was approved by Council as part of the Development Approval Process. The requirement of the FMP to maintain a 2.5 metre wide Fuel Control Zone (FCZ) inside the POSCWP has not as yet been addressed and there are a number of regrowth trees within this zone presenting an immediate and longer term risk to the building. David Houghton (Houghton Environmental) author of the FMP has confirmed the intent of the FCZ. was to ensure only fire retardant species, to a maximum height of 300mm, existed within this zone, which also included the need for removal of existing trees. David Houghton has advised that the approval process of the FMP required close consultaion with the QFRS, and Council subsequently agreed with the terms of the FMP and the need to maintain a clear FCZ, on the basis of recommendations from the QFRS. (Copy attached) Representatives from QFES and RFB have recently inspected the site and concur with the need to maintain the FCZ clear of existing trees. Specific concern has also been raised by the Emergency Services with respect to the proximity of the trees and the concern for the safety and damage to the building as a result of falling trees and limbs. (Copy of minutes of meeting attached) Environment & Ecology representatives of Houghton Environmental and Taylor Ecology have both identified the need for the removal of selected trees within the FCZ and have confirmed that they represent negligible ecological value. (Copy attached) Council's own website encourages owners to prepare for a possible bush fire event, and clause 5.6 of the Covenant states: “Notwithstanding anything in this Covenant, if vegetation in the Covenant Area poses a risk to human safety the vegetation may be cut down or trimmed so as to remove the risk with prior written consent of the Council, whose consent cannot be unreasonably withheld” We therefore seek consent to clear the trees as soon as possible. As we can access the area via the adjoining site, for the next 6 — 8 weeks only, a prompt response would be appreciated. Yours Faithfully (ae CLIVE BROWN CHAIRMAN OF THE BODY CORPORATE.
